Last week, the N.C. Secretary of State’s web site had no record that Cops for Kids was ever incorporated. As far as the Secretary of State was concerned, Cops for Kids did not exist.
But by Thursday afternoon, several days after questions began to arise about the charity operated by Mooresville Police Chief John Crone, the Secretary of State’s Web site was now reporting that Cops for Kids was incorporated as a non-profit entity in June 2001.
All business entities incorporated or otherwise formally organized under state law are registered with the Secretary of State. The secretary’s web page includes a means by which business entities registered in North Carolina can be searched. Documents available through the web site for each registered entity typically include organizations’ articles of incorporation and annual reports.
On June 27 , Cops for Kids was not among the business entities listed on the Secretary of State’s Web site. Crone himself said in an email to the Gatton Report on June 30 that Cops for Kids was not incorporated and had never secured tax-exempt status as a charity under federal tax regulations. “We are not incorporated, nor have we ever been, nor have we advertised that we are a 501C charity,” Crone wrote in the e-mail. However, Interim Town Manager Erskine Smith alerted town commissioners in an e-mail on Thursday that a search of the N.C. Secretary of State’s web site revealed that Cops for Kids had, in fact, incorporated as a non-profit entity in June 2001. “We have found that the Mooresville Cops for Kids is a non-profit corporation under the State of North Carolina,” he wrote to the commissioners. “It was incorporated by the State on June 29, 2001.”
A review of the Secretary of State’s web site on Thursday afternoon by the Tribune and Gatton Report found an entry for Cops for Kids that is not present on the June 27 print-out of organizations registered with the Secretary of State beginning with the word “cops.” Nor was such an entry present on the secretary’s web site as recently as the early part of this week, as it should have been if the organization had been incorporated in 2001.
On Thursday, however, when a search of all registered entities with “cops” as the first word in their names was conducted, the five organizations present on the June 27 print-out were still present. But so was a sixth entry that was not present on the June 27 list: Cops for Kids, Inc.
The new version of the Secretary of State’s web site states that Cops for Kids incorporated in June 2001, with John Crone as the organization’s registered agent. Here's a scanned copy of the July 3 search results:
While the web site appears to represent that Cops for Kids was incorporated in 2001, the page, as of mid-afternoon on Thursday, did not include any scanned versions of the documents typically available through the secretary of state’s web site, such as the articles of incorporation or the annual corporate reports. The page where such documents would typically be located was simply blank. But, by approximately 3:15 p.m. Thursday, articles of incorporation were posted on the secretary’s web site.
Local attorney Ben S. Thomas is listed on the articles of incorporation as the incorporator of the organization. Thomas said that he was the incorporator of the organization and that he contacted the Secretary of State on Thursday after hearing discussion in the community about the status of Cops for Kids and finding the organization was not listed on the secretary’s web site. “This is the first time in 20 years that I’ve ever seen that,” he said.
Certified articles of incorporation, which are returned to organizations by the secretary of state after incorporation is formalized, were not present in the Cops for Kids files made publicly available this week.
Also, there is no entry in the Cops for Kids’ financial records indicating that the required $60 payment was made to the Secretary of State in 2001 to cover the cost of incorporation. The secretary of state will typically reject articles of incorporation submitted without payment.
Crone could not be reached to explain why, as recently as the early part of this week, there was no record of Cops for Kids on the Secretary of State’s web site, nor why he previously said the organization was not incorporated.
George Jeter, director of communications with the Secretary of State, told the Tribune and Report on Thursday afternoon that he can’t explain why Cops for Kids was not listed earlier this week on the secretary’s web site but showed up later in the week. “It was clearly incorporated in 2001. I had them scan and put in the articles of incorporation. There’s no reason it wouldn’t have been up, not unless there was a ghost in the computer,” Jeter said.
In addition to the status of Cops for Kids as a business entity under state law, town officials are also revising their previous statements about the organization’s tax-exempt status. In an e-mail to the Tribune on Thursday afternoon, Smith stated that Cops for Kids “has not paid any taxes. The Chief has never represented that the organization was a 501(c)3.”
But later in the day, Smith said it was always the intention of Cops for Kids to file for tax-exempt status and that an oversight was responsible for the failure to secure the status. “The counsel for the corporation did not file the required paperwork to the IRS for a tax exempt status. (Chief Crone had signed the application and attached a check payable to the U.S. Treasury for the application fee.)” Smith said in an email.
A copy of the documents was not available by Thursday afternoon.
A search performed Thursday of the Internal Revenue Service’s list of registered 501(c)(3) charities still did not identify Mooresville’s Cops for Kids as a tax-exempt organization.

I, too, call on Erskine Smith and Police Chief Crone's immediate resignations. In the event they fail to resign, I call on the town board to terminate Mr. Smith and immediately suspend Chief Crone pending the results of an outside investigation of not only Cops for Kids but the any and all financial matters under the care of Chief Crone.
Ms. Gatton, I shall be e-mailing you directly to discuss this matter further.
I hate to say it but these boys have some pull. I find it hard to believe that the corporation was on the books when the site was first searched, so someone back dated these articles of incorporation and loaded them on the web site. I think it is time to call the FBI as well, because if these people in town government can have files altered in the Sec of State office, we have larger problems than a slush fund in the Police Department.

I want to know where the canceled checks are for their Annual fees paid to the Sec of State for their corp. and if there are any corresponding entries on the balance sheet or bank statement for those amounts. Please look.
I have heard that Crone's daughter is a professional poker player. Shall we look there?
The NC law enforcement community has known for years that Crone is a shyster. He was hired at Newton by his best buddy (City Manager Burchins) just before he was to get the boot in Washington. Crone then did what he does best - he covered up a lot of wrongdoing in Newton, including drug abuse, harassing phone calls, and the like. Newton was just a quick stopping point to keep him employed until his "family" could get him the job in Mooresville. Nothing I've read here surprises me at all. Glad you got him. People really have no idea how corrupt law enforcement management has become in NC in many areas. It is sad.
I have searched Secy of State records hundreds of times over the past years, and this is the first I've ever heard of this type of situation. It smells of politics and influence. Mooresville, do not let this rest. If you dig, you will find all kinds of dirt. Demand a full investigation, including the Secy of State's office. Demand resignations on the local level. Your voice can and will be heard, you just might have to scream a lot. Send this info to the Charlotte Observer, the television stations, and anyone else who will listen. Don't let these fools get by with this any longer.
Let's don't forget the FBI, now that the Sec of State has been compromised.
All of sudden it makes sense why none of the investigations in this town ever went anywhere. Crone and his cronies were putting the lid on them as soon as they were started. We're just going to have to keep going over as many heads as we have to and bring the whole house down from top to bottom. Let's do this!
The people reading and posting to this blog have to come to Monday night's town board meeting. If we the people don't make a strong showing, the commissioners will be able to sweep this whole thing under the rug. It's one thing to complain on-line, but another to actually show up and let them know we are not going to accept this kind of behavior.

This is like watching a magic show. First, the webpage of COPS For Kids does a "disappearing act" on the town's website. Then, it does kind of a "reappearing act" on the Secretary of the State's website.
When I wrote my check to COPS For Kids, it was a charity. Last week, Chief Crone told us "oops, sorry, it's no charity." Just as I was beginning to process and accept that, WALA! COPS For Kids is a charity again, according to Crone and Erskine Smith.

The real person behind the scenes who needs to resign is Jackie Moore, H.R Director for the town. She has led all the recent directors around by the nose and is waiting to see who the next town manager will be and whether or not they too will be pushovers that she can rule. Ms. Moore, you are a bully, an ineffective professional who doesn't know her place. With Lois Compton gone, we have no chance at fair play in this town! Jackie rules every dept, including the matters at the police dept. No one dares speak out lest they be subjected to disciplinary action.

If you want to know where some of the Cops for Kids money went check out the playground equipment that Crone gave to his church.
He actually spent it on a BLOCK PARTY for his church. Must be nice. Just use charity dollars on your own church to get in good with everybody. The heck with whether that's right or wrong.
Crone is a petty tyrant using the advantage of his office to intimidate others and benefit himself. Be thankful that this is the United States, there are countries where a petty tyrant can kill you instead of trying to bully you. If you let him get away with this he will have more power and be more brazen. Who knows who his next target will be. He will seek out anyone who he thinks was against him. Those who seek to benefit themselves through corruption will feel they can do that in Mooresville and get away with it. If the town council does not get rid of him get rid of them. Those who govern seem to forget that they govern because we allow it not because they have been anointed. If the good people of Mooresville allow evil to prevail they will one day find that corruption has destroyed their town.
Corruption HAD nearly destroyed this town. It all started under Joe Knox' era. Corrupt to the bone it got. We started taking this town back in 2002 and we shall not stop...Either you are with us or you are against us.

So guess who Joe Knox groomed to take his place when he saw things were going south real fast? You got it. The mayor of any other town in America would have called an Emergency meeting of the Town Board when the Gatton Report was refused access to documents and would have agreed with Miles Atkins and drilled the lock. The public confidence is worth more than a damn lock or Crone's feelings of violation, but we have a town board and town manager who wanted to wait or clean up? I think if Erskine Smith wasn't involved, he would have called some other law enforcement agency to come in and look to protect himself and the town. But you know how it went down, stall and cover, now we have possible tampering with Sec of State documents. I know how the Sec of State's office works their annual fee on April 15th each year, and they misplaced the documents for 7 years?( Brazen contempt for the public is what we have here.) There must really be some dirt to expose if people were willing to try this stuff already earning over $100,00.00 a year in salary + take home vehicle+ retirement/benfits,trips,etc. to keep the light of day out of Mooresville. I feel better every minute knowing my tax dollars are going to pay these salaries.( SHOW ME A FISHERMAN AND I'LL SHOW YOU A LIAR; SHOW ME A POLITICIAN AND I'LL SHOW YOU A CROOK! ) But Slick Willie will be like Schultz on Hogan's Heroes--"I Know Nothing, Nothing!

I agree, the Gatton Report has my blessing to round up all those with an unbalanced checkbook that purport themselves to be legally registered as a charity, especially when their job is to help the ones in need.

There is no doubt in anyone's mind that you disliked Matt Burleyson, you voiced that over and over and over.
Now tell us all why you were punished by the chief and allowed to keep your job, I think you lost one stripe. Not too bad for you and your wife after you were caught stealing from an elderly citizen in Mooresville that Banked at your wife's work.

I just got a phone call from a citizen of Mooresville about my name being on this blog. I use to work at the Moorsville PD. I was never accused of stealing any money from any elderly person. I don't know why I was brought into this blog. I don't know why someone would attack me or my wife. I live over a 1000 miles from Mooresville. I don't keep up with what is going on there. I did read over the blogs. I did like working for Chief Crone and loved working for the people of Mooresville. I left the PD for a civilian job making twice as much money. I was also able to move closer to my family.
I think it is sad what is going with the Chief, the department, the citizens, and mostly the officers.
The officers of the PD are some of the best I have ever worked with. So please have some respect for the officers. They do work hard for the taxpayers.
I think it is a bad when someone over a 1000 miles away has to get a blog to defend himself. I have no axes to grind with anyone.
I don't have a 3 year old daughter so I don't know that was brought up in a Blog.
I wish the best for the Mooresville, it citizens and most of all the police officers.
I have identified myself and would the person who attack my family identify themselves.
