SBI coming back to Mooresville, town investigation to begin soon

The State Bureau of Investigation is coming back to Mooresville.

22nd Prosecutorial District Attorney Garry Frank said Wednesday that he has been contacted by the Town of Mooresville and that he is “taking steps to initiate an investigation” into Police Chief John Crone’s Cops for Kids organization.

Town Attorney Steve Gambill said that Frank will contact the SBI. While Gambill said he “cannot speak to when an investigation by the SBI will begin or how long it will take,” the town’s internal investigation will begin “as soon as possible.”

Gambill said that Town Finance Director Maia Setzer is “working on the external audit regarding Cops for Kids.” He said he does not know if a firm has yet been retained.

This makes the second time in about three years that the SBI has been called to Mooresville. Town commissioners in May 2005 requested an SBI investigation after an independent audit of the golf course pro shop turned up nearly $9,300 in missing golf merchandise over an 8-month period during fiscal year 2005. During a follow-up inventory count, $4,545 worth of that merchandise was “discovered.” Though the DA’s office received the SBI results in September 2005, the findings have never been released to the public or town officials.

Then in March 2006, federal agents visited Mooresville Town Hall as part of an undisclosed FBI investigation connected to the town’s controversial 2004 hiring of engineering firm CH2M Hill for the town’s wastewater treatment plant expansion. The results of that investigation – if it has been completed – have also not been released.

This is the third time for the SBI to come to Mooresville. The golf course and CH2M HIll reports were never released. Why? Was not taxpayer money involved? Is this report going to keep from the public also? Then why investigate?
Our money is taken but we don't have a right to know. That is government for you.

It isn't easy going againest the grain. My hats off to those individuals who are fighting so boldly to combat these actions. just remember, we can't expect an overnight change. It didn't get this way overnight and likely will take much more effort but it will be worth it to be able to walk down the street or say what you mean and be able to sign your name without fear of repercussions or losing your job because you excercised your first amendment right of freedom of speech.Good job, we appreciate you so much.

Crone has a hard time lying on camera doesn't he.
Crone was well aware of the anonymous blog as he shared this with his officers when The Gattor Report first wrote about take home cars.

Crone admitted there may be a check or two that was written that could be in question....
Let's keep this going, the investigation will be long and hopefully accurate in all that needs to be done. The citizens have spoken and so far atleast someone is listening. Crone is not at work, let's keep it that way.

Crone is not at work, but Erskine Smith, Crone's personal shield still is. By the way, somebody told me Smith's town car has been parked in front of his house for over a week. I went to check it out for myself and sure enough it's there even though he isn't. That car is town property. We paid for it, and if he isn't using it, it needs to be at Town Hall. Why do we have a town resource such as a vehicle parked in front of Erskine Smith's house gathering dust?

Be sure the SBI talks to Mr. Smith, because according to his statement in the Gatton Report article "What about the town's $20,000.00 to Cops for Kids," he states they discussed it as far back as January. He also recommended the 20K himself re. CFK, so he knew about it for sure. Why did it take the Gatton Report inquiry to get his attention to it? (Oh Hell, they found it, time to play dumb)Those are our tax dollars paying for complaceny or complicity! Performance Review-F

This is a continuation of the "Count Up Vigil" of the number of days which pass from the day Cops For Kids scandal broke (7/4/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The Police Chief was suspended on Tuesday, 7/8/08. The community clearly continues to be relieved and deeply grateful to whatever forces brought that timely suspension about.

However, Interim Town Manager Erskine Smith remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville.

The town board has placed Finance Director Maia Setzer in charge of oversight of this process (including but not limited to any investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which the Finance Director reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the nonprofit corporation known as Cops For Kids

2) Mr. Smith's direct recommendation to the town board to include the nonprofit corporation known as Cops For Kids into the town's general budget

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching Cops For Kids prior to submitting his recommendation to the town board

4) Mr. Smith's involvement in a questionable commission in the amount of $237,151.50 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends gouge Mooresville taxpayers”, the contents of which have never been publicly disputed by Mr. Smith.

This is Day No. 6.

The situation with Erskin Smith's vehicle is yet another example in a series of instances that alert us there may be an epidemic of "Entitlement" in the upper management of Mooresville. Just as Police Chief Crone felt "entitled" to use funds from Cops for Kids for outlandish trips and such, Mr. Smith feels entitled to hold on to a town-owned vehicle at his residence. This sense of entitlement will continue until and unless elected officials put an end to it.

SBI investigation will be a joke. D.A. will do nothing – as usual – except keep telling us that “the report is in the mail.” One hand feeds the other. The golf course was feeding Crone’s Cops For Kids through the yearly golf tournament that brought in tens of thousands of dollars. So of course any "investigation" of the golf course was going to be a pure sham. Now, the D.A.'s office and the SBI are going to humor us again and run us around by our noses until we get tired and give up. In the meanwhile, Erskine Smith will keep his buddy Chief Crone in the loop and give him the heads up whenever he needs to. Crime is only crime if you don't wear a suit or uniform and have a fancy title. These are your lawkeepers people. Wake up and smell the rotting smell of a failing system.

Where’s that report, Mr. Frank? And then he endorsed his do-nothing lackey, Alan Martin to continue his do-nothing legacy. Same guy who the Gatton Report exposed had offered 7-year plea to Misty Witherspoon for shooting her husband in the back of the head while he slept on the couch. By some dumb luck she turned it down, otherwise thanks to the genius D.A.'s office we would have a cold-blooded murderer prancing around here in a couple of years. And now we're supposed to wag our tails again because the imposters are back in town? Show me the money. Until then, this dog's tail is laying low and ears are bent back.

Regarding the additional funding for cable....I was all ready to get up and speak. The agenda listed the time limit for public comments on this issue so I thought that the board would be interested in hearing from the taxpayers and that this would be the appropriate time to speak my piece.

Moments later...they voted for it....no public comments. I guessed the board learned from last summer. The easiest way to avoid all those annoying negative public comments is to breeze right by it.

Thanks for hearing my thoughts, gentlemen. Why do you bother letting the public in?

I never could understand why the investigation of the golf course finances was never released. Now it is all starting to make sense to me. This is all just downright scary stuff. We think we're safe because the police is there, then we hear the police chief is being investigated. We then think we're safe because the D.A. or the SBI are in charge, then we hear that they like to drop the ball, either accidentally or yeeeek, on purpose. What in the world is going on around here?!

I believe if the active people in this revolution are going anywhere, then we need to go past state level.
Maybe a bigger organizattion like the IRS? On their web site they have many routes of contact. I may be wrong, and please correct me if I am, but if you are not registered as a non profit organization. Then you need to pay your taxes. It makes sense to me, but i will probably be bashed by someone. I'll just act like i am inferior and run and hide every time my mayor wants a piece.
On the IRS website look for the form 3949-A( look for tab INDIVIDUAL and then highlighted tax abuse). This form allows you file a complaint against someone who is suspected of tax fraud. I may be hard to follow here but if there are enough pieces of paper with the same name, it will get noticed.
Ohh and too everyone that is full of non-progressive hate: "you can kill the protester but you cannot kill the protest"(AF)

I know now that you fully understand that I knew what I was talking about. The sad thing is... there is still more that has not began to surface. I would love to see some "turnover" figures for the few years before Crone arrived, just to compare. Also, everyone should keep in mind that the SBI will not be the answer to everything. They will have a very narrow role in their investigation rather than sweeping with a wide broom (like we would like to see) Anyway, keep up the good work and try to stay on track people.

(March 25, 2008)--The City Council in Copperas Cove voted 6 to 1 to oust Mayor Roger "Odie" O'Dwyer in a special city council meeting Tuesday morning.

O'Dwyer protested the move but council members ignored his charges and took action anyway.

O'Dwyer has been the subject of accusations of impropriety in office for several months; his detractors saying he routinely violated city charter by issuing direct orders to city employees in violation of the city charter that prohibits the mayor from taking "hands-on" action.

After the short proceeding ended, O'Dwyer could be heard at the back of the room asking news reporters when they might undertake a real investigation of the matter.

On Saturday a private citizen issued formal complaints against city council members charging the panel had not properly used directives in the Texas Open Meetings Act to announce a meeting on March 11 that led to Tuesday's action.

Those complaints have been forwarded to the Coryell County District Attorney's Office but as yet have not been acted upon.

Northfield mayor misused power, investigator says

Northfield Mayor Lee Lansing improperly used his role as a city official to further personal and family interests, according to an outside investigator hired by the City Council.

In a report delivered Monday night, attorney William Everett, of Buffalo, Minn., told the council that Lansing exerted improper influence in an attempt to have the city relocate its municipal liquor store to property owned by his son, David Lansing, and David's development partner, Paul Norby.

Lansing also successfully pushed the city to reduce -- by more than $20,000 -- a park dedication fee that the city proposed to charge the developers, the report says.

And Lansing misused his city office in a dispute with developers who bought the building that houses his family's hardware store, according to Everett. In particular, Lansing tried to block the developers from occupying the building, the report said.

Everett also examined several other issues related to city business, but found no evidence of wrongdoing. A report investigating the city's relationship with its engineer has not been finalized.

Everett did not, however, look into issues related to an ongoing criminal investigation that Northfield police had initiated of City Administrator Al Roder. The investigation, details of which have never been made public, was turned over to the Goodhue County attorney's office, and Everett didn't go into the matter on the grounds that it could undermine the ongoing probe.

Nor did he take up data-practices and open-meetings violations alleged in a lawsuit filed against the city this fall by the mayor and his son. The mayor later withdrew himself as a plaintiff in the case.

Everett gave the council a 61-page report, plus three pages of information that were not released to the public because of data privacy laws.

The City Council hired Everett this fall after the state auditor declined the council's request to investigate a handful of potential problems with the way the city is run.

Lansing's offenses constitute a violation of the city's ethics code, Everett said.

"I am just dumbfounded," Lansing said after the meeting, adding that, if he had acted improperly, it was "certainly not intentionally."

Looks like we aren't the only town with criminals running the show...

I know that this is slightly the off topic. 7:57-- you said that the only way this town will get any better is if you get rid of all the southerners.

I was born and raised here in the south. I don't mean to sound modest but I believe that I am pretty intelligent. Government Corruption is not a southern problem alone, it is an American problem. By placing the blame on one group of people then you are basically saying the rest of this country is great when it comes to local, state and national governments and if you haven't read or seen the news lately I'll help you..it is not.

Also in case you haven't realized Mooresville, North Carolina is in the south. So say what you want but I don't think that any of us "southerners" are going anywhere, anytime soon.

To the northerner who has lived here 10 years...I myself am from the north , been here 14 years and I love it!!! I must say its people like you that give people like me a bad rap. There was really no need to bring the north/ south thing up. Jamie is a great investigative reporter and I believe she is doing this because she loves this town and wants the best for her family and friends. She became a reporter because she CARES!She was born and raised here in the South. So, If you can't stick to the subject at hand then don't bother leaving any comments.

How can we get information to the SBI agents who will be working on this? Not sure what you're experience is with them, but mine has always been top notch.

I think I may request a freedom of information act release of any an all e-mails to/from town officials regarding this blog. It would not surprise me if some of them are actually using city computers and/or phones to post.

Rev Larry Green is an idiot. He complains about ANYTHING that deals with city government. He's the only pastor in town that gets a letter in the editor section of the Tribune about once a month. No other pastor in town would even think of saying some of the things he says in a public forum. He would be the person that complained about the fire department taking to long to respond to his house fire, even if they saved the house and put the fire out. He would be the person that complained about the town trash truck being too loud when it empties his trash can, even though his trash can wasn't positioned correctly on the curb and the trash truck driver had to get out and maneuver the trash can by hand before it could be emptied properly - thus the reason the truck sat idling in front of his house being too loud. He complains about the police department, but wouldn't hesitate to call a cop in the middle of the night if he heard someone outside his house..."Come check on the prowler please, even though I bash you in the media". He even has the nerve to complain about the crew on Main St doing road construction in a public setting (restaurant). Please go away Rev. Larry Green!!! Hopefully your trash will get emptied, you won't actually need the fire dept, and if you happen to need the police for something, they will send Sgt. David Clanton to help you.

Re. July 10th, 737pm post. I agree about not holding your breath when it comes to the out-going DA and assistant, but there are many things that you don't know about the Witherspoon case. Number one being that the MPD so mangled the crime scene and the handling of the evidence, that Mr. Martin had no choice but to offer a deal at the bequest of the Witherspoon family. The only reason that deal was turned down was because it was withdrawn almost immediately, due to pressure from the MPD and the Concord PD. Also, if you want to know the whole truth, the good Chief Crone offered a deal well before that one was placed on the table. Sure the SBI, may be moot at this point, but leave the Witherspoons out of this. They have enough to contend with, due to the judgemental people of this town.

Why can't they work at night to finish early?Our cars are being ruined by this. Mooresville Tribunes' website says that the SBI is likely to join the investigation, which indicates at least some uncertainty. Have the, indeed, been contacted? What are the parameters of their investigation? And how do we get the results from the previous investigations by SBI and the FBI?

I read today in the Tribune that town attorney Steve Gambill found the internal investigator who was "recommended by a long-time friend". My questions is WHOSE long-time friend? Is it Gambill's long-time friend, or Thunberg's long-time friend, or Erskine Smith's long-time friend, or Crone's long-time friend? etc. etc.? For that matter, why are we hiring ANYBODY'S "friend" to do this investigation?

Of all the investigators on this planet, we go and find somebody who just happens to have lived on the lake for the past 6 years. I hope somebody warned him that he's going to be under a microscope. If he is here to help Smith and Crone cover up some more, we are gonna be holding somebody's feet to a real big fire and some heads will be rolling.

I know what your thinking Sparky, I'll just take the pictures and info down but it is to late, already made copies of your site and have put them in an email with all the BS you are saying to send to all your closest friends and faculty on campus, (well, truth be told, everyone one campus I am sure I will hit a professor o or two of yours) and pulled email address to a database to make it a one click shot or would you like to say something else to me.

This town Mooresville has a great location, great people, but their DA, police, and sheriff's department in Iredell County is the most corrupt organization that I have ever encountered in my lifetime.

Why the FBI does not come in this mess, I do not know?

Look at all the complaints by people on this website, on the blogs...it is ridiculous!

Gary Frank you are a joke along with the SBI !

You have this police chief that has obstructed Federal and State laws, and it took a town picketing the office to get the SBI and DA to act. It will go away.

Then you have a Mooresville Police man pull over a man a few years ago with an AK-47 in the car; you do not even seize the weapon, and then he goes and shoots people a few hours later, and then you attempt to cover it up!

Then three years ago you have a police officer's who were arrested in hotel for having a porno shows and filming. Mooresville's finest again!

Then in 2003 Gary Frank and company arrest a local physician who was falsely accused of touching his nurse in a room with a patient.

The woman who falsely accused him also worked with her sister in the same practice who gave officer Chad Berstrum (who no longer is on the force, another bozo) information to exonerate the doctor, by sharing with this officer that her sister had shared with her several days prior to the accusation that she was setting up this doctor.

This was told by the sister, a family member of the girl who falsely accused this doctor. Officer Chad Berstrom replied oh yes, I know Dr. ____ he was in my wedding, and when we got divorced, he and his wife would not speak to me, but don't worry, I will not let this get in the way of my case.

They went ahead and arrested this physician, put it in the paper, news, and local television, it ruined this man, he lost 50% of his practice, was publicly humiliated and his children because a bunch of bozo DA's, and this uneducated police chief Cron, and keystone cops, did not do their job.

You want to hear how the man was exonerate?
He is a Christian and begged the DA to reconsider the evidence and the testimony of the sister who tesified against her own sister that she was lying and setting up the doctor, but they would not listen.

So he asked the Lord to please bring forth help, and expose this matter in truth.

The day before the trial, a man called the doctor's office and shared that he heard what was happening to him, and "that he was getting railroaded" (IMAGINE THAT RAILROADED IN MOORESVILLE)

He then told him that this nurse called him and wanted to come by his house after he left his office one day for his appointment, and solicited him, the patient for sex.

The patient offered deposition, and the DA had to drop the charges. It was just like the Duke LaCross case where a confident DA, thought he was God and untouchable until the media tried the case on National TV and he lost his license.

Gary Frank, I pray that you and all your "Cron"ies lose your jobs, and license to practice law, and every other police officer who is corrupt. You and your organization is a farse, and you are a disgrace to the profession.

I hope that in the future the FBI and other government agencies come into Mooresville and clean house.

PEOPLE OF MOORESVILLE, IF YOU WANT CHANGE THEN YOU ARE GOING TO HAVE TO GET THE HISTORY OF CORRUPTION AND THEN TAKE IT TO THE MEDIA, PICKET THE COURTHOUSE, AND THEN VOTE HONEST PEOPLE INTO "YOUR" GOVERNMENT.

ALSO YOU NEED TO CHANGE THE STYLE GOVERNMENT, CORRUPTION.

BRING IN A POLICE CHIEF FROM WHO IS EDUCATED AND THEN REQUIRE THAT THEY HAVE A COLLEGE EDUCATION, AND YOU WILL CLEAR HALF THE POLICE FORCE OR AT LEAST THE CORRUPTION.

It is obvious that people love Mooresville area, and rightfully so, a beautiful lake; close to the interstate freeway and Charlotte area; great opportunity for employment, and good schools; great growth potential, and great people who come from the North, East, South, and West to make this their home.

So where did all these corrupt government people come from, "HELL"?

It takes voices to bring change. People who vote for new leadership; sending petitions to the United States Attorney Generals office and Senators with your complaints, and when they get 10,000 letters on their office and the media asking them what they are going to do about it, then they will act on the people's voices; have people write, send e-mails and call up the local and national media, ABC 20/20, NBC Dateline and have them come to town to interview that "rotten" DA like in the Duke LaCross case.

Put some of them on television like they did Crone and they will change or get ousted out.

You bloggers keep on blogging and make your voice heard, and you will get the attention.

How do you think that the Bill of Rights were finally past? Martin Luther King marched with people of all cultures and races and demonstrated with signs, and holding meetings just like you good people did to get Crone out of office.

Keep on doing it and the media will come and it will get the attention of the entire United States which these people who are corrupt will not like.

Darkness hates the light, meaning expose the darkness by letting your voice be heard, and wit the media attention, you bring light to the matter.

Then somebody should run an article in the newspaper or ask people to publish their story
on a website where they were done wrong by the government because of corruption in this Iredell County, and to set up petition stations with a petition asking for the dismissal of Gary Frank, and others who "the people" have determined are involved corruption throughout Mooresville, and Statesville.

Government official are to represent the best interest of the people and guide by the laws of the land, and not with prejudice and corruption, the government is the people.

These officials are not representing people, but their own interest, and obviously it is out of hand, so this is the time for "the people" to let their voice be heard, and purging the old leadership, and replacing it with new.

From the Mayors office, DA, Police Chief, and others or those who "the people" have determine
are corrupt and not equitable.

So make petitions, and set up these stations throughout the county, and then let the people
sign the petitions. When you get 50% or more of the town signing it, then people will listen.

Send these petitions and letters of complaint to Washington DC, the State Attorney Generals office, local government offices, the local media, and national media, ABC,CBS, NBC, CNN, and other cable networks, and believe me one of them will come to Iredell County and do the story.

Then these bullies will be exposed!

Then these people will be "forced" out of office,
and then you can replace them with new young leadership.

For example, If I were going to choose a person to seek out for running for mayor in Mooresville, I would asked Mrs. Cynthia Peabody who is a CPA.

She is an accountant which means she knows how to balance budgets and work on a government level with understanding of numbers and regulations being familiar with government; she started her own business from the bottom, building out a office in the Gateway and it has grown successfully; and she likes people, helping people. This is a person who would serve the community of Mooresville, and these are the "public servants"
that are needed to make it an "equitable community" for all to live and enjoy life.

Maybe you know someone who would be a good candidate, and then seek them out and ask them to run.

My good friend who is a United States Marine and was President Carter's presidential pilot said this about the election of Jimmy Carter.

Jimmy Carter never ever planned to run for Presidential office, but the candidates were not representing the public interest of the people.

So one day, he decided "if" I were to run for President what would I do "for the people", what ten things would I do for the people of the United States to make it a better land to live.

He wrote those ten things down, and then decide to share them during a public speech and had a great response and backing of the people.

He then threw his hat into the race, and he began to build momentum by the people. Those who lived during this time remember that he was not the favorite at this time by the Democratic party or machine, but when convention time came he had so many people who had rallied behind him, that they could not ignore him and he was their candidate.

His life has represented "the helping of people" no matter what party belief, or cultural background, he represented people.

These are the people that you need in office in Iredell County, not corruption, but individuals who will listen and represent people and usher in positive and equitable change, representing the voices of people because it is these people who represent the town of Mooresville, and are the government.

People are the government, and only people can defeat corruption.

People in Iredell County, you have a voice.

It is your town, not their town, and if they held dear their representation of people, they would make people feel important thru just and humble service, because the greatest leader is a servant, and this is what a government servants are carry out their life, serving the needs of people to form a more perfect union and community and to guide equitably with the laws made by and for people.
