Early review points to Cops for Kids problems

We’re still sorting through the hundreds of pages of records retrieved yesterday from the police department’s Cops for Kids files. The work to fully analyze the data has just begun. But this much already seems apparent:

There were no financial controls regulating Cops for Kids. There was no town oversight, and no one making sure money was deposited and spent as it was supposed to be. So the accuracy and thoroughness of the record keeping is questionable at best.

That said, it appears that very little money from Cops for Kids has been spent since at least 2001 on needy children, seniors or families, which is the stated purpose of the organization. There are a couple of receipts in an 8-year period from grocery and retail stores, but many of them lack documentation of who the purchases benefited. There are plenty of records of payments to hotels, but none of them are in Mooresville or anywhere in the Lake Norman area. There are no records of payments to power companies or landlords, as one might expect to find in the financial records of an organization that claims to offer emergency assistance to people who, as explained by the Cops for Kids website, are in need of “basic necessities” as a result of “unfortunate circumstances.” (By the way, as of Monday afternoon, the Cops for Kids page has been removed from the police department’s website.)

Among the many documents that the Report obtained from Police Chief John Crone yesterday, there were no guidelines or rules governing how needy individuals and families can apply for assistance, nor any criteria to determine who is eligible to receive such assistance. There were no applications that could be filled out to request such assistance, nor any completed applications seeking such assistance. There were no materials — pamphlets, flyers, brochures, letters — to help publicize the assistance Cops for Kids purports to offer.

Also not present in the Cops for Kids files were articles of incorporation, by-laws, lists of officers or directors, meeting minutes, annual budgets, annual tax filings, or annual audits — the sorts of documents one would expect to find in the files of a legitimate charity.

What the records do show is that thousands of dollars in Cops for Kids money has been spent every year since 2001 to send members of two groups of children called the "mayor’s youth council" and the police "explorers" -- along with police and public officials and their wives -- to places such as New York City; Washington D.C.; Gatlinburg, TN; Pennsylvania; Niagara Falls; and Atlanta. (As an aside, I'm not sure at this time of the criteria for inclusion in the mayor's youth council or the explorers program, but I can tell you that included in the youth council are several privileged children who incidentally have attended several trips funded by Cops for Kids.)

Does that mean that Cops for Kids has not benefited children and youth in the community? Not at all. In fact, every year, Cops for Kids holds a “Breakfast with Santa” event for area children and hands out t-shirts, donuts and milk. Cops for Kids has also contributed $500 a year to the Rotary S.T.A.R.S. program for at-risk children in the Mooresville Graded School District; it has sponsored area baseball and softball teams and has donated $100 a year in recent years to a non-profit basketball camp. Cops for Kids has contributed money to Mooresville High School’s band boosters, it has donated $50 to Lake Norman Christian Outreach, and it has helped sponsor a “block party” hosted by Broad Street United Methodist Church.

But for the thousands of dollars that the organization brings in every year – it collected $24,920 from the 2007 golf tournament alone, in addition to thousands of dollars in individual and business donations – very little is given to underprivileged or needy children in the community, and a whole lot is put back into the annual golf tournament and the annual mayor’s youth council/explorers’ trips.

Take the time period from July 1, 2006 to June 30,2007, for example. According to a police department list of expenditures and revenue, $125 was paid to Wal-Mart in July for what appears to be a needy child, and $352.90 was spent to purchase items for needy children on an angel tree at Christmastime in 2006. Also, Cops for Kids paid $500 to the Rotary S.T.A.R.S. for at-risk students, and it paid $133.44 to host Breakfast with Santa for area children.

Then, consider the $3,250 that Cops for Kids paid just to charter a bus to take the mayor’s youth council and explorers – consisting of 22 students, including Crone’s daughter and the former mayor’s granddaughter, and 14 chaperones (seven p0lice officers and their spouses, including Crone and his wife) – to Washington D.C. from June 1-3. Cops for Kids also paid for 17 hotel rooms – nine doubles and eight kings – for the weekend, in addition to meals, a Washington Nationals baseball game, and various “sightseeing” visits, some of which included ticket costs.

The Mooresville Police Department’s Cops for Kids program, on its website, represented itself as a charity and solicited thousands of dollars in funds as such. But as of yesterday, the Cops for Kids webpage – which detailed the program’s intent to help children, seniors and families in need – was removed from the police department’s website. Shortly thereafter, Crone e-mailed the following statement to the Report:

“I don’t know how the web page for Cops 4 Kids Inc. got on our website. My guess is that someone within the Town Government (possibly even the police department) accidentally thought that our ‘Cops for Kids’ was part of the Cops 4 Kids Inc. The WEB page is being removed, and I apologize for the confusion.

“We are not incorporated, nor have we ever been, nor have we advertised that we are a 501C charity.

“Neither I or either of my two majors have knowledge of approving this web page. There are many Cops 4 Kids organizations on the web, some are incorporated, and I guess someone with good intentions got them mixed up. The Mooresville Police did not start their Cops for Kids until 1997 and no one is paid a salary. At one time we looked into applying for a 501C3 designation but we changed our mind and just left it under the police department.”

But even if Crone – in his 10 years as police chief – was not familiar with the police department’s website, and even if it was the police department’s intention all along to use Cops for Kids money primarily for jaunts for themselves and privileged children, we’re still left with the question of proper accounting.

Many of the receipts included in the Cops for Kids files did not document what they were for or who the purchases benefited, which would seem to be a violation of town policy. Another interesting discovery while sorting through the Cops for Kids files at the police department yesterday: A plastic baggie with $492.37 in cash in a folder titled “miscellaneous.” Though handwritten notes were in the folder, there was no clear explanation for the cash, and Crone had no explanation because he told us in another context yesterday that he had been advised to refer all questions to Erskine Smith.

We asked an expert to ring in on Cops for Kids’ lack of organizational documents and records to see if the concerns we have about Cops for Kids are misplaced. According to Tom Kelley, a professor at the University of North Carolina at Chapel Hill School of Law who specializes in non-profit-law, "All of this does seem peculiar. Sounds as if they’re not actually a charity."

The answer to the peculiarity that Kelley detects is that Cops for Kids has never really operated as the charity it held itself out to be. The town administration, including Erskine Smith, takes the stance that the Cops for Kids fund has always been Crone’s own "personal spending account." In recommending that Cops for Kids receive $20,000 in public funds in the 2008-09 town budget, Smith, knowing that Cops for Kids was used as the chief’s “personal spending account,” recommended that our tax dollars be put into a fund that is not subject to any financial controls or oversight -- a fund from which money has been doled out over the years at the sole discretion of the police chief, with no one checking behind him to make sure the money was being properly spent.

There is much more work to be done, but this much already seems clear: Cops for Kids, for a number of years, was presented to the public as a charitable organization that helped children, seniors and families in need, but in fact, the money collected by Cops for Kids was not used, at least substantially, for that purpose.

Additionally, Cops for Kids was operated for years — a time during which it took in and spent tens of thousands of dollars — without the most basic financial controls or any independent oversight, thereby eliminating the accountability necessary to operate government for the benefit of the people and to ensure town employees do not use their public positions for private gain.

As we continue to sift through the records, we’ll keep you updated on what we do — and do not — find.

Matt Burleyson and his wife, Lisa were participants on every one of those "trips". All this didn't matter until Matt got fired and wouldn't be able to go on the "trips" anymore. Matt didn't want to blow the whistle as long as he was part of the show. The real mistake by Crone was hiring a former car salesman (Burleyson) as a cop. He should have known that car salesman = crook.

Sound like it is a black hole, a lot goes in and nothing comes out, but it all disappears. I am wondering how an account that has that much money going into it have no controls? If this can't be answered; what other types of corruption are going on in the police department that the chief has a hand in? But most importantly what can we or our government officials do to correct this?
There has to be something other than calling and filing a complaint. Don't get me wrong i will be calling and we need the people to come together. The people united will never be defeated.
This situation has a very sneaky and vague feel to it

Simply amazing....if Smith recommended we put $20,000 from our budget in to this program this year he HAD to know what the program was....a personal spending account for the Chief with sparse records.
Glad there was no fat to cut from the budget so we wound up with a tax increase.

This is to whoever wrote at 8:33. Are you sure it was Matt's firing that blew the lid off of this mess? I don't guess it could have had anything to do with the chief advertising this blog to all the officers at the police department when Gatton was trying to take the cars away. To figure out who's talking ain't as easy as it was a month ago.

Wait a minute, does not Erskine Smith head up the Mayor's Youth Council? or did he? Has he been on these trips? If he has, did not he know what the money was being used for when he recommended the Board approving it? Has his kids been on it? Has any other town official's kids been on it?

This fund is obviously being used as a slush fund for a "few" priviledged kids to take trips, along with Town employees and keep it off the Town's travel budget radar. Why not take under-priviledge kids? That is what the funds were specified for. If you look at the few good things the fund has done, I'll bet it is less than 10% of the total collected and spent.

That is alot of money being made on a golf tournament - $25,000. Better look into who was paying for golf teams and which city employees "actually" played on those teams without paying. I think you may find some interesting relations with City officials and those that paid their golf fee.

Again, what a sad story. The Town appears to be rotten to the core with all officials involved - all indicators point to a government and it leaders out of control, willing to forego ethics for self gain, or just trips, or maybe just golf.

Just look at all that has happened in the Town over the past four years. I do not understand why the SBI, FBI, DA, or other law agencies have not been looking into matters.

I hate it for the good employees that do their job everyday and serve the public - police fire, public works, budget, ect. Great job Jaime!

It is all of a sudden making sense why Crone had these records locked up and hidden from scrutiny while he was away. We can only speculate as to how much of this would have actually seen the light of day had Ms. Gatton not defied him and the town manager by showing up at 9 a.m. instead of 3 p.m. that day as they had instructed her to do. Alot of cleanup can happen in six hours which didn't happen as a result of her incredible tenacity and courage. Now they have to do all the cleaning up right in the open where we can all see. Let them. It is usually in the covering up that thieves and crooks are caught in their own web of lies and deceit. If we had twenty people in Mooresville like Ms. Gatton you would be able to eat off the floor it would be so clean here.

So if the police would investigate a scam that meant the loss of a couple of hundred bucks, why not investigate a scam that may have misspent thousands of dollars a year--all out of the police chief's office?!

I can just see the press release now: "The Mooresville Police Department is warning residents to be on the lookout for Mooresville Police Chief John Crone, who has been observed promising to help children and families keep a roof over their heads and food in their bellies. The police are warning the requests appear to be part of a scam designed to provide posh vacations to Crone and his relatives, friends, and business associates."

What John Crone has done here is morally unconscionable. For every single dollar he has spent out of this program for himself, his wife, his child, and his friends, that has been a dollar he has robbed from this community’s neediest, the silent forgotten. This is what rots a community to its core, very much in the same way as termites can ravage the most magnificent of homes.

Apparently when Gatton showed up at the police department at nine in the morning to look through the Cops for Kids files she had a couple of other women with her. Crone couldn’t get much cleaning up done with those three hanging out. Instead he and Erskine Smith got together in Town Hall to get their stories straight. So instead of holding Crone’s feet to the fire Smith is actually working with him to get off the hook. Total repeat of the library scandal years ago when he tried to cover up the former library director’s embezzlement. She ended up being convicted of felony embezzlement when the media finally got a hold of the story. But Smith got to keep his job by the skin of his teeth and got most of his responsibilities taken away but same salary (go figure). He laid low for a few years and it looks like he’s back at his old tricks.

Somebody asked earlier about the whereabouts of the mayor and the commissioners in all this. Well, I know every single one of them, and I can write the book for you. The RATS will back Police Chief Crone even if Crone is led away in handcuffs. In case you have not been on the blog long, the RATS are: Rader (at-large commissioner), Abraham (Ward 1 commissioner), Thunberg (the very “honorable” mayor) and Smith (interim town manager). Your only hope is that the Big Four (Houston, Carney, Herring and Atkins) will stand strong and keep doing the right thing as they have shown they can do in recent months. By the way, Thunberg and Rader's seats are up for grabs in fall 2009.

You would have thought after the library fiasco some procedures would have been put in place. Where is the 'management' in Town Hall? Evidently it's just shaking hands and slapping backs.

Why is the Town Attorney not looking over activities like Cops for Kids etc. to be sure they're legal and in compliance. Surely he's not there just to put out fires. How about a little fire prevention.

And what about the Finance Director? Isn't part of her job to put systems and procedures in place to keep this kind of stuff from happeing? Did she nor Gamble not know about this fund? It was on the Town web site. Couldn't be much of a secret. Did they raise a flag to the Town Manager or to the Board that this program existed but was operating without the supervision or approval of the Finance Dept or the Legal Dept? If not, why not?

And then the Auditors for the Town. Why haven't they brought this up? Don't they check on systems and procedures to see that they are in place and operating properly? Why haven't they brought this up? If all they are doing is sitting at a table and checking totals of columns of numbers perhaps we are paying them too much.

At first it was the library and now the PD. People receiving and spending Town funds (taxpayer funds) and nobody in Town Hall knows anything about it. Lets do this. Let's ask EVERY Town employee 'do you receive funds, either cash or checks, at a Town office or from a Town address?' At least at that point we know who is handling funds. Evidently that's more than we know now. Lying would be grounds for termination. Then someone from Staff or even the CPA firm sets up systems and procedures for the handing of these funds and assigns someone the responsibility of seeing that they are carried out.

Sounds easy enough to me. Am I missing something?

Nope. I think you've pretty much hit the nail on the head. The only thing you may be missing is that there is a leftover infection from the library scandal, and his name? Erskine Smith. And like any infection, it will eventually spread again, as it has done here. As long as Smith works for this town you can expect a repeat of situations like this.

I believe that John Crone's email to the Report is total horse crap. For a man who proclaims to be intelligent and on top of his PD, please tell me how he could not know about the website. There is no way. This is Crone's way of lying his way out of this mess. He has created it, now he is in it.
IF anyone believes that a person with good intentions placed that description of Cops For Kids on the MPD website, without direction from Crone is wrong.
Please call the numbers that are listed, I have and have gotten good response. People's ears have been opened and will hopefully be in touch with the Town Officials and Crone. Keep the phone calls up.
The Chief of Police stealing from the community, can't be good.
I made the mistake of playing in the golf tournament twice. They spare no expense in give aways, and rubbin elbows with the whose who in the area.
I am embarassed to say I played, or rather I was played. Never again. If enough people keep talking and the commissioners that are not corrupt stand up for the citizens of the town something can get done.
Maj Robbins is wrong when he says Crone has the only set of keys to his office. That is a town owned building, someone has an extra set. I am sad to see Carl Robbins becoming a yes man. But he knows he is only a minute away too from being fired if he crosses Crone.
Crone is all about his officers being honest, let's hold him to the same level. I am sure the results of a lie detector test would be interesting to see.

The only way it will be brought up is if you do it during "Public Comments." I don't know, Miles Adkins has the integrity to discuss it, since it is a festering boil on everyone's seat except his and Carney. The Board will probably instead approve the 12.5 million for M-I, and vote Erskine Smith as town manager. They tend to act contrary to logic when confronted with calamity.

Chief Crone's comments sounded dumb, but...So are Frank Rader's comments as he struts around town clucking his tongue at how everybody is making a mountain out of a molehill about Cops for Kids. Perhaps his calculator is broken. Would anybody like to please give him a new one so that he can go back to being a "Numbers Man" and figure out that something is just not adding up here?

Maybe the Town of Mooresville should take a look at the HR manager for the Town. Ms. Moore seems to think she is the Town Manager anyway. Guaranteed she has plenty to say with what takes place in the city government. I believe it's time the citizens of Mooresville keep an open mind for change.

To the last poster, You known Matt Burleyson isn't with the MPD anymore. Did you not see the Blog in ref to the DARE officer firing? I don't believe Matt did anything criminal, do you? This post is about the actions of the chief, and those he will bring down with him. I think the majors will hang him out to dry on this one, I think it was all Crones doing. Truth me known the Major Robbins & Major Hillard do not respect the Chief and try to stay away from him. There is Blocker who will try to defend him, unless it gets to ugly for even him.

Jaime you do a great job, these men do not like you because they can't do whatever they want while you are watching. Thank goodness there is someone like you that will stand up for the citizens of Mooresville. I these people were honest they would'nt mind you looking into the money trail. Keep it up for those of us that can't opening express without loosing our jobs.

I do agree with the 1 poster that said that we should hold the chief up to his own standards- he says if you lie you will be fired! ( or given the OPTION plan)

they've stood by his side watching crap like this happen for years on end, they stood by his side during his complete mishandling of the Witherspoon case, and i believe they wont stop here.

Those who knew and remained silent, those who went on trips without questioning where the money came from deserve a piece of whatever is coming.

The Majors will not hang crone out to dry, they will help in the cover up because they know their butts are on the line.

THE CHIEFS COMMENT ABOUT THE WEB SITE MAKES ME SICK! To say that he did not know what was on there is just too much! He is the chief! His hand is in everything at the dept. But watch out, He is going to try to blame it on someone else in the dept! Stand back everyone, it's not giving away "stuffed animals" but he can and will make this someone elses fault and fire them as well. You never know who will be next.

I just hope the "Big Switch" doesn't happen; the story they told the Gatton Report they would print, or a sanitized version the town wants run. I hope the two articles preserve the investigative integrity on this issue, because if the Tribune doesn't cover this on the up and up, they will have compromised their jounalistic integrity. I am hopeful, but the way they have covered the Burleyson "departure" without a correction, I don't know.

Smith and Crone need to pack their bags and hit the pavement looking for new work. Maybe they can bunk together until they find their news jobs running scams in another town.

All he has to do is show up, once in a while, and play golf on town time. If he hadn't tried to get in on the sweet CFK honeypot nobody would have been any the wiser. ADKINS TELLS MR.ADKINS ALL THE GOOD STUFF.MR ADKINS IS FEEDING JAMIE INFO FROM MATT OR MATT'S WIFE.
SEE HOW EASY THAT WAS. MR. ADKINS
WE ALL KNOW YOU DON'T LIKE THE CHIEF.SO YOU WERE FEED INFO FROM MATT OR HIS WIFE, DID NOT KNOW WHAT DO WITH IT, SO YOU WENT TO YOUR NEIGHBOR, JAMIE WITH THE INFO.
