Free Speech or Speech Under Duress?

Free speech is completely different than speech under duress.

Unfortunately, we’re left wondering which was exercised when six officers and one dispatcher wrote letters to elected officials on Saturday and Sunday in support of Chief John Crone, who is suspended with pay pending the results of investigations into the way he handled the police department’s Cops for Kids program.

Mooresville Police Capt. Frank Falzone, along with five of his squad members and one dispatcher on his same shift, wrote the letters to commissioners over the weekend. It appears the officers, on town time and using town resources, quite possibly wrote the letters at the suggestion of their immediate supervisor, Falzone.

“We are concerned that our lack of or inability to publicly voice our opinions, for fear that we may cause additional controversy and complicate your efforts, may be misconstrued as a lack of support for Chief Crone,” Falzone wrote in his e-mail on Saturday. “We have concluded that notifying you by email is the best alternative in accomplishing our goal, without further obscuring the issue at hand.”

Continued Falzone: “I would like to reaffirm and emphasize my support for Chief Crone, and unless proven otherwise, firmly believe in his leadership, skills, and abilities.”

Falzone’s letter was the first of seven – out of 59 total police personnel – to be sent to town commissioners. By the next evening, five of Falzone’s squad members and the dispatcher had also submitted letters to town board members.

“Chief Crone has tried to show his love of children by his work with the children/teenagers in the community,” said the dispatcher. “I feel that he is unfairly being accused of things that people do not have the whole picture or information about.”

The dispatcher is the only police department employee who mentioned the facts surrounding Crone’s suspension. “As for the money situation,” the dispatcher said, “I am sure that even if receipts are not located for each and every dime, that he spent the money for something to do with the children he was working with.”

A police officer who said he has worked with Crone since Crone was hired as chief in December 1998 urged commissioners to “support Chief Crone during these trying times for our department and our town.” He said that Crone “has always treated me with respect and dignity” and that “I have always tried to give him that same courtesy.”

Another officer who said he has worked with Crone for more than seven years told elected officials: “I’ve never known (Crone) to be dishonest about anything going on at the department. I’ve always been treated with fairness, respect and honesty … all traits he demands from his officers.

“In summary,” the e-mail read, “I support Chief Crone as he goes through this difficult time.”

Another officer stated that he was also writing to express support for Crone. “Unless shown otherwise,” he stated in his e-mail to commissioners, “I will continue to support Chief Crone during this difficult time, and only hope that this matter will be resolved as soon as possible.”

In a memo-style letter with the subject titled “Letter of Support,” one officer stated that “Chief Crone is an extraordinarily hard worker, a responsible person, and he is an asset to the Police Department, Community and the Town of Mooresville as well.”

The final officer to write commissioners on Sunday said that he has worked with Crone “for many years.”

“This e-mail is not to say that I think the Chief is perfect,” he stated, “but I can honestly say that I am a better officer because of the years I have worked under Chief Crone's command.”

“I hope that you haven't misunderstood the silence from officers to mean that we do not support the chief,” stated the officer. “The vast majority of officers do support him. The turn over rate of officers at the police department is more that just numbers and with each officer leaving, there is a reason.

“Again, I fully support the Chief and hope that this will soon be over and we can get Chief Crone back to work where he should be.”

He ended his letter by thanking the commissioners for their time and “for allowing me to work for the Town of Mooresville Police Department, which I thoroughly enjoy, and for your support for the police department.”

Since each of the officers – with the exception of the dispatcher – work under Falzone, it is impossible to know which ones voluntarily wrote letters in support of Crone and which ones did so because they felt their boss had suggested that they do it.

What is clear is that at least one member of that squad who was on duty this past weekend did not write a letter to commissioners – along with more than 50 other people employed by the police department.

Did Falzone order his squad members to write the letters in support of Crone? Did he suggest it? Did he consider, when making such a suggestion, that his squad members may take his suggestion to be, in fact, an order? Did he consider that some officers might not want to write such letters and by not participating could therefore eventually become targeted for ill treatment by other officers, higher ranking officials or Crone himself should he return? Did Falzone write his letter with intentions of swaying the opinions of elected officials, who must wait until the investigations’ results before casting judgment?

Unfortunately, we don’t have answers to those questions. Falzone couldn’t be reached for comment yesterday.

What we do know is that the officers violated town policy by writing the letters because they wrote them using town resources and while on duty. All the letters were sent from the employees’ town e-mail accounts. The police department’s personnel policy states that “members shall not engage in political activity on duty, or when acting in an official capacity, or when in uniform, except to vote.”

The policy also states: “Members shall not interfere with cases being handled by … other government agencies unless: A.) Ordered to intervene by a supervisor; or B.) The intervening member believes, beyond a reasonable doubt, that injustice would result from failure to take action; or C.) Such intervention is required as a result of supervisory or command responsibilities.”

Maj. Carl Robbins, who is serving as interim chief of police in Crone’s absence, said today that the police department’s personnel policy “does address these type activities. I will gather the facts and then handle it as a personnel matter,” he said.

But really, a violation of the personnel policy should be the least of our worries. I am a staunch supporter of every person’s right to free speech, and I am elated when I see people embrace and exercise that Constitutional right, even if I disagree with what they say. Am I disappointed that the police department employees violated the personnel policy? Absolutely. But there’s a mitigating factor here: Their boss introduced to them the idea of writing the letters. What effect did that have on the officers? How voluntary were the letters really? Was it proper for a commanding officer to put his subordinates in a position where they might have felt uncomfortable not participating?

The fundamental issue here lies within the question of whether those particular officers practiced free speech … or if their speech was less free than some officers hoped it would appear to be.

And how about the officers who couldn’t in clear conscience write a letter of support, whether they don’t support Crone or they simply didn’t want to violate the personnel policy? What will this mean for them? Will they be punished for not participating?

The mere presence of these questions is reason enough why no one in the police department should have suggested officers write letters in support of the suspended chief.

Was Falzone by any chance on any of those expensive trips the chief took his family and friends on - using COPS FOR KIDS charity dollars? And who put Falzone up to this? Sorry but I just can't see a captain going out on a limb on his own without feeling like he had some "backing" and reassurance that this was the "right move" for him and his squad. Call me jaded.

I just CAN'T believe it!! From the excerpts of the emails, it seems as though one person wrote all the emails and had the few people scared for their jobs sign their name to it. This whole thing is just getting so ridiculous. Fire Crone already and get it over it with for God's sake! GEEZZ!!!

An "idiot"? What is the relevancy of that comment. Again, folks who don't want to accept reality call people names or throw out red herrings. I think a first grader can understand this: it is not proper for a captain at the police department to have his subordinates to send emails of support for their chief when the chief is under suspension and under active criminal and civil investigation. This conduct is not trivial but simply an illustration of the overall environment that the citizens are dealing with. It's unfortunate that the captain or officers felt this was something appropriate for them to do and it would lead someone to believe that the instructions came from someone who was perceived by the captain to have authority. The article clearly points out the internal policy violations. To his credit, the interim chief indicated that he will take care of this personnel matter and surely there will be discipline but no one will lose his job over it. Thankfully, due to Ms. Gatton's hard work and her numerous reliable sources, we are able to know about this instead of it remaining hidden. All here should be very thankful about the current transparency in our government and the fact that someone is willing to get this information to the public in such a timely and responsible manner.

Could you get the names of the officers that sent the emails, since they sent them on town time and on town computers?

The fact remains that a supervising officer and other officers of the MPD BROKE a TOWN POLICY.

This is not the Gatton report "telling" on people b/c they went 3 minutes over on a lunch break. This is the Gatton report unconvering the misuse and abuse of powers some of the MPD staff. Nothing more nothing less.

If these people support the disgraced Crone, then call him at home and tell him. Call the town board at home and tell them. DO NOT BREAK POLICY.

I know others that have alledgely broken MPD policy. Their fate: unemployed.

Why would the e-mail say "we" if there had not been some sort of discussion about sending the e-mails? Why send it to board members, because they have no ability to hire/fire Crone? Town policy was broken. Does not matter if was forced or not. This little letter as you call it once again shows how some officers at MPD feel they are above the law.
This is not silly. This is the type of leadership that leads to scandal that disgraced Crone finds himself in as we speak.

Times have to change, the silly things, as you call them, have to change as well. These things grow and fester and then become a Crone.

It sounds as if Robbins is going to handle this problem of his officers and their superior breaking policy in an appropriate manner.

Again i say, I know of others that have alledgely broken policy and have been fired.

I don't see anywhere that the personnel policies address tardiness other than for habitual tardies. It then prescribes a series of actions required to be taken in order to remedy the deficiencies.

The Major told the troops on Friday to not engage the public, but the Captain chose to do otherwise. I believe the policy manual refers to that as insubordination, and prescribes the remedies to those activities.

Robbins seems straight and will take whatever action is appropriate. due to the high turnover rate anyway, lets not call for firings or forced resignations.

eric-truth be known,there are very few grunt officers in the MPD. There is more rank there than in the military! They just did this "fluid promotion" where a select few were promoted without going to a board like normal. They just woke up one day and had a nice little pay raise. Our little worthless High School officer got a 10% raise to sit on his butt, also, there is a traffic officer that does "NOTHING" but also got a raise. (But she used to sit in the chiefs office all day everyday, why?) There is Capt.Blocker that does NOTHING, just what are we paying him to do? When he talks he has NO idea what he is talking about. He recently spoke to a group and told the people in attendence(who were having problems with other peoples children)that they could put these other children in their personal cars and drive them home. DUH What was he thinking? You don't put children in your car without parents permission! What a dummy.(of course he did throw away evidence in the Witherspoon investigation.(maybe thats why the chief took him out of investigations? He kept making him look bad) And finally we have Falzone that is writing letters on the chiefs behalf to the town board, give me a break! (did the chief tell him to or is he really blinded by the chief. I am hoping that Maj.Robbins will be firm in dealing with these people. (I hope he has the back-bone to do it) The public trust is in the toilet and flushing fast.

This is a continuation of the "Count Up Vigil" of the number of days which pass from the day Cops For Kids scandal broke (7/4/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The Police Chief was suspended (with pay) on Tuesday, 7/8/08. The community clearly continues to be relieved and deeply grateful to whatever forces brought that timely suspension about. However, serious questions are now mounting with regard to Mr. Smith's decision to continue paying Mr. Crone a salary.

Interim Town Manager Erskine Smith, Mr. Crone’s supervisor, remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville due to his role in this matter as well as other matters that have been brought to light.

The town board has placed Finance Director Maia Setzer in charge of oversight of the CFK process (including but not limited to any investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which the Finance Director reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the nonprofit corporation known as Cops For Kids

2) Mr. Smith's direct recommendation to the town board to include the nonprofit corporation known as Cops For Kids into the town's general budget

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching Cops For Kids prior to submitting his recommendation to the town board

4) Mr. Smith's involvement in a questionable commission in the amount of $237,151.50 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends gouge Mooresville taxpayers”, the contents of which have never been publicly disputed by Mr. Smith

5) Mr. Smith’s failure or refusal to change Mr. Crone’s status to “unpaid” suspension despite the surfacing of various contradictory statements made by Mr. Crone in the media since his suspension

It doesn't take a genius to figure out that somebody high up winked and nodded at Falzone to "suggest" to his subordinates that they need to write "letters of support" for Crone. So who would this person or persons be? It's kind of a short list. Who's over Falzone? Carl Robbins and Kendall Hillard. Who's over them? Erskine Smith. Who's over him? The mayor and town commissioners. We already know Crone's got the backing of Smith, the mayor, and commissioners Rader and Abraham. So, we just gotta figure out who winked and nodded at Falzone and we'll know who is part of the Cops For Kids conspiracy, because this is starting to smell an awful lot like a conspiracy. The FBI needs to be called into the situation and pronto.

Billy, Crone is a public government official, and writing to political representatives (the town council) is engaging in political activity. The town council has called in the SBI. The District Attorney is involved. So yes other agencies are involved. If assumptions are being made, why is Carl Robbins acting on Ms. Gatton's questions about the policy? Why would you insult Ms. Gatton then turn around and ask her to look into what you want her to look into? Typical.

Rader would jig even if he had witnessed the chief taking the cash money directly from the evidence room to the bank. Rader can rationalize anything: he is the champion of government owned cable and CH2MHill. What more needs to be said. The real question is what drives Rader? To quote Bill Thunberg in his infamous statement about Gatton, maybe Rader is just "someone trying to be relevant". Well, his 15 minutes are up.

I agree 100% that the Feds need to be called into this situation, if nothing else so that they can restore public confidence. They need to come in and begin interviewing people from top to bottom, starting with elected officials, moving down to management, and then staff. The exposure of the circumstances surrounding these "letters of support" has seriously tainted any remaining credibility that our town government had. Desperate times call for desperate measures.

Here's the way I see it: The RATS (Rader, Abraham, Thunberg, Smith) tried to pull a fast one on the Big Four (Carney, Houston, Atkins, Herring) by putting Falzone up to manufacturing support for Crone. It was disturbing, to say the least, reading this article. It appears that the fog of suspicion which has surrounded the police chief may now be filtering into the police department. This is potentially very harmful for our community. For the sake of our community, the town board members must exert sufficient pressure to replace the police chief as quickly as possible before this problem spreads any further and leads to the erosion of the police department, upon which we rely for our safety. Failure to do so would be tantamount to gross abdication of their duties and could lead to serious liability.

The first part says that you don't know if Falzone introduced the idea and your second part says that Falzone did introduce the idea. Which part is fact? What do you mean by "introduce"? It seems that the only fact is that police officers wrote these emails while on duty.

BTW are commissioners forwarding emails from town employees to this website? I know that email may be considered public record, but what message are the commissioners sending by forwarding emails to a website. If I were a town employee and I wrote an email to a commissioner about my boss (positive or negative) I would not want my writing to be in direct quotes on the internet.

That makes it a for profit business that took in hundreds of thousands of dollars over the course of ten years, and that is only between 10,000 and 20,000 dollars a year, and I bet that is such a low estimate. Probably more like 50,000 per year. 20 years of a for profit business not paying taxes is 1,000,000. or about 300,000 in tax owed because crone did not know what he was doing. (not knowing the law does not help him, ask any lawyer.)With no products being sold other then the "good will" (extortion) of the police department and when I say good will, I mean, give me money and you will get special treatment by me and my officers, I bet they did not even give those phony police stickers to their victims.

But make no mistake, it was a for profit business where John Crone AND his officers went door to door or called by phone and extorted money from them, ie. Hobbs act violation. Also, for every individual attempt to "get" money from a business or resident it is another felony charge, so if you gave him 10 dollars today, 100 next month and 100 in two months, that is 3 individual felony charges of violating NC GS 14-100, now multiply that by the number of people that donated and you will begin to see the shear number of charges we are talking about. It will be hundreds, if not thousands. Every time he or his individual officers even so much as tried to get money from people, they did not even have to get the money, it is another charge. Another hundreds or thousands of felonies for the attempts.

Every officer that made the attempt or succeded in getting the money is also going to be charged with felonies. I bet right now that half of your department if not more are guilty of felonies, and their only hope not to be charged is that they were to stupid to know what Crone was doing. However that is a double edge sword as if you were to stupid to know what is going on then you are too stupid to be a police officer. (sorry to use that word)

No one has any idea what is about to happen to your department because they do not understand NC GS 14-100. It is a vicious vicious law with saber tooth like teeth, I do understand, which is why I brought it up in the first place and why I am forcing a federal investigation and why John Crone, needs to be arrested, right now, his passport needs to be taken, as well as any firearms and his badge. People with this many charges, are prone to flee or commit suicide. I am begging your people to save his life right now.

The town of Mooresville is about to fill its jail, with police officers and town council and think of the problems that is going to cause.It is not going to be safe for any of them. Protect them, I promise you do not understand that law.

Call in the feds NOW, you have no choice in the matter, either you do it, or I force it.

But either way, it is going to happen, get out of denial now while you still can save some of these people.

Everyone in town needs to go to the Town hall ASAP and remove your elected officals. Call towns and counties near you and get there help, this is no joke! This is an emergency and no one seems to be looking at it like that.

The county DA can not be impartial. Neither can the independant investigator who is a "personal friend" He will back out of this when he relizes what is going on. No one will touch this with a ten foot pole.

Seems that there should be a blog just to sling insults to anybody for anything. The comments lately have nothing to do with Jaime's topic. It appears that the email story has been reported and lets give the Major the benefit of the doubt that he will take care of it. Regardless of the officers intentions, I don't see how their actions will effect the SBI or any other investigation. I'm sure none of the officers like what is going on and its probably somewhat distracting from their duties, and they would like some resolve soon also.
Please, current and former officers stop insulting each other over he said, she said. Every company has employees who get their feelings hurt by each other and I doubt if police are any different. This type of behavior on both sides is disturbing and you guys should be above that.Of course, if you know of criminal activity please report it to the SBI.
Remember everyone should be here for the truth in regards to the cops for kids investigation, instead of attacking each other and straying off subject. Looks like Jaime is keeping up to date on that investigation, she will post news as it happens.

Instead of speculating on the appropriate use of Cops for Kids funds, why not ask the people and businesses who donated those funds how and why they got involved? Select a few sponsors from the Cops for Kids golf tournament information and ask some questions of them. They will no doubt be able to recount the names of people who contacted them, what they donated and whether they listed Cops for Kids donations on their tax returns. Find the information with research rather than assumptions.

Hey, while you guys are asking around, maybe you should ask the crime victims and those accused of crimes how they feel about their money being taken from the evidence room and put into the chief's fund? I'm no legal expert but surely there is not a provision in the law that allows that to happen without some kind of court order. I've heard somebody familiar with the courts say that any money in an evidence room that can't be returned to its owner for some reason has to go to the schools. If that's the case, that part of the Crone case is a no brainer. Doesn't take a rocket scientist or the SBI to figure that out.

This is a continuation of the "Ink Pen Gate Vigil" of the number of days which pass from the day the ink pen was stolen (7/16/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The ink pen was stolen on Wednesday, 7/16/08. The community clearly wants to find out what has happened to the taxpayers ink pen. However, serious questions are now mounting with regard to Mr. Smith's decision to not call in the SBI, FBI and National Guard.

Interim Town Manager Erskine Smith, the keeper of all ink pens, remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville due to his role in this matter as well as other matters that have been brought to light.

The town board has placed Helen Keller in charge of oversight of the ink pen location process (including but not limited to any investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which Helen Keller reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the missing ink pen.

2) Mr. Smith's direct recommendation to the town board that he chews on ink pens sometimes.

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching and hunting down the dirty rat that stole the ink pen.

4) Mr. Smith's involvement in a questionable commission in the amount of $0.32 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends steal taxpayers ink pens”, the contents of which have never been publicly disputed by Mr. Smith

5) Mr. Smith’s failure or refusal to change all the locks on the doors, filing cabinets and storage bins.

This is Day No. 2.

When placed in the context of Mr. Crone committing violations of NC GS 14-100 which states,

“ If the value of the money, goods, property, services, chose in action, or other thing of value is one hundred thousand dollars ($100,000) or more, a violation of this section is a Class C felony.”

As the total value of the property obtained will exceed 100,000 dollars (after the forensic accountant adds up the losses over the past 10 years) in value and Mr. Crone admitted to at least one count on television of violating 14-100 (and will therefore be convicted on all counts which will number in the hundreds) in regard to CFK paying for the holiday party for the department, Mr. Crone will be found guilty by a jury or judge of a Class “C” felony then NC GS 15a-1340.16a will kick in as Mr. Crone committed said act while displaying a firearm, which he would carry in the normal course of his position as the chief of police.

C, D, or E felony and the defendant used, displayed, or threatened to use
or display a firearm during the commission of the felony.

If a person is convicted of a Class A, B1, B2, C, D, or E felony and it is found
as provided in this section that: (i) the person committed the felony by using, displaying,
or threatening the use or display of a firearm and (ii) the person actually possessed the
firearm about his or her person, then the person shall have the minimum term of
imprisonment to which the person is sentenced for that felony increased by 60 months.
The maximum term of imprisonment shall be the maximum term that corresponds to the
minimum term after it is increased by 60 months, as specified in G.S. 15A-1340.17(e)
and (e1).
(d)
An indictment or information for the Class A, B1, B2, C, D, or E felony shall
allege in that indictment or information the facts set out in subsection (c) of this section.
The pleading is sufficient if it alleges that the defendant committed the felony by using,
displaying, or threatening the use or display of a firearm and the defendant actually
possessed the firearm about the defendant's person. One pleading is sufficient for all
Class A, B1, B2, C, D, or E felonies that are tried at a single trial.
(e)
The State shall prove the issues set out in subsection (c) of this section
beyond a reasonable doubt during the same trial in which the defendant is tried for the
felony unless the defendant pleads guilty or no contest to the issues. If the defendant
pleads guilty or no contest to the felony but pleads not guilty to the issues set out in
subsection (c) of this section, then a jury shall be impaneled to determine the issues.
(f)
Subsection (c) of this section does not apply if the evidence of the use,
display, or threatened use or display of the firearm is needed to prove an element of the
felony or if the person is not sentenced to an active term of imprisonment. (1994, Ex.
Sess., c. 22, s. 20; 2003-378, s. 2.


Mr. Crone, you chose not to do the right thing and turn yourself in when I told you too, now being an officer of the law, you must understand that every charge I level against you on the Gatton report MUST now be investigated to the fullest extent possible by the SBI in the case of state charges and the FBI and Secret Service for Federal Charges.

You may have been able to sweep this under the rug at one point but that is before I found out about your crimes not more then 6 days ago. I don’t know you, but I promise that just as you have charged criminals in your town with everything under the sun when you arrest someone for even so much as shoplifting, to make yourself look better you are now going to be charged with every singe violation I can think of as I am a firm believer in fair play. But don’t worry, I will only level charges I believe can be proven in court. No “pleas” here.

I am now turning the tables on you, you should have done more to protect the innocent people of your town and not ruin peoples lives with huge numbers of trumped of charges in an effort to make your self look better to the crooked people you serve. And to those people above and below you, I will be looking into you as well after, crone, you are “safely” behind bars, I am going after them with the law. Your town is my new cause celeb. And you are the poster boy.


I am your worst case scenario, I have a brain and a very deep understanding of the law and how things work in the justice system on a state and federal level. And the FBI reading this should understand this, when you call, I will come and help them just like I am helping the town, whether it knows it or not.

If I were a law enforcement officer, I might have some sympathy for you as the blue wall of silence dictates, but you are not that lucky.

And to the people reading this post, pick apart the law, do not attack me personally, prove him innocent.

Mr. Crone, you have another 72 hours to do the right thing, turn yourself in, I will go away and quit posting your crimes, I am not as vindictive as you to have someone arrested on a Friday night so that they MUST spend the weekend in jail before seeing a judge. I know your games. Bank on it.


Next charge, Monday afternoon, It gets worse and it will be federal this time.

Tiff, Ink Pen Gate is just beginning my friend. I came to this blog thinking that Jaime Gatton and all of her sheep would jump at the chance to punish whoever it was that broke policy by stealing that ink pen. It appears that I was mistaken. But fear not, we will get to the bottom of this and to whomever took that ink pen you will spend many many years locked up in Federal Prison for what you have done.

The golf tournament is an "attempt" to raise as much money as possible, including over 100,000 dollars creating "great monetary loss" under the false pretenses that it was for charity.

The charity was not a charity it was a for profit business account, everything after the does not matter.

14-100 does not require that he actually have received the money, only that he attempted to, to be found guilty of a class C felony.

The comments on TV has done him in, not me.

The interpretation is not flawed.

We have a name for people who compare taking a pen from work to stealing from charities meant for children and the elderly. The word is "Sociopath".

The big problem, of course, with sociopaths, is that they often assimilate nicely into society and look and act fairly normal. They even hold elected office, run successful businesses, even head up police departments. You can pass one on the street and say hello to them and think they're a pretty nice guy.

I just noticed on the internet that one of the finalist's for the city managers job is the current town mamanger of Cary, N.C.
I wonder what he is running from? Cary is the 5th fastest growing town in the United States it has a popultion of over 130,000 people. Why would he want to downsize to a town 1/5 the size of Mooresville. They the board will probably pay him enough to hire 4 Erskine Smith's.
He will regret the day that he comes here. Check their web site in Cary and see all the taxes that they have there. You will not believe what all they tax.
The other fnalist is from Ohio according to the Mooresville Slander Sheet I mean the Tribune

As an original member of the "Fringe Lunatic Seven" I am amazed at what has happened on this board. As John Lennon once said "Strange Days Indeed".

I have a hypothetical question....if someone contributed $$ to the "Cops for Kids" golf tournament and then deducted their contribution on their Schedule A...aren't they guilty of tax fraud if Cops for Kids turns out to NOT be a registered charity, as it appears now?

(And for the record...I don't play golf and would like the town to subsidize the bowling alley instead if they are looking to invest in any more non-essential businesses with my tax money.)

Comment...I would say that all eyes are on you. The citizens are waiting to see if you have what it takes to do "your" job (at least the job that is your's for now) and hammer the officers that went against a direct order as well as the policy book that is in place.
Question.... Have you notified Training and Standards about the suspention of Crone as required.

There is a Training and Standards Commission ran by the State in Raleigh. It certifies all officers with the power of arrest in NC. (All NC law enforcement agency that is) You cannot be a officer till they certify you and make sure that you have completed all traing that is needed and passed all background checks required by them. Once you are certified you can then work with the power of arrest. They can also revoke or suspend your certification. I do not know the procedures that they do this by. After you leave a agency you can go to work for another agency if you do it in 12 months of your leaving your past job. After 12 months you have to go back to all the schools and training and backgrounds again.
I am sure that you can Google the commission.

Chief Crone installed a camera in the break room to catch whoever was taking Coca Colas. The camera's cost was over $600, paid for by tax dollars. This effort was widely known throughout the MPD, and we called it Cola-Gate. Ask any officers and they'll tell you.

General observation. Cops for Kids has a float in the annual Christmas parade every year. What kids have represented the organization on those floats? And are they the same children that benefited by going on these trips. I am not sure of the answer ... But I have a pretty good guess.

It is soooooooooo amazing that people "think" that none of the officers support Chief Crone. Then when some do support him, you want them dead also! Just maybe, the officers that wrote those e-mails support their Chief, as they should, until it is proven that he actually did something wrong. Contrairy to what some of you wish, it is possible that even though you have already got him hanging from a tree, he could actually be cleared because ... believe it or not - it's possible ... that he did nothing wrong. Sloppy record keeping is not a crime. Burleyson getting fired, while "possibly" wasn't justified is no reason for people to hang a man until he is convicted the proper way. Even Matt Dillon knew that on Gun Smoke. Get a life people!!

Last time I heard, caring about where my tax dollars go, what happens to the money of citizens that is held in a "secure" evidence room and where my charity dollars go is my personal business. And it is the personal business of any real citizen who cares about the future of democracy. And last I heard "sheep" would better define the people who would allow all three to be stolen from them by corrupt government officials without questioning it whatsoever. And to the person who is sooooooo whatever.....tell your husband to leave his gun and badge on Chief Robbins desk when he leaves work tomorrow. Chief Robbins so far is the only cop I have looked into that I would say deserves the keep his badge and the Chiefs job as he appears to have integrity above reproach . Of course I am not done with that but I dont think I really need to go any further with him, he is not one of the dirty 7 as far as I can tell. The tone of your voice tells me you are trying to protect either a relative or a spouse. Good luck with that.

This is a continuation of the "Ink Pen Gate Vigil" of the number of days which pass from the day the ink pen was stolen (7/16/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The ink pen was stolen on Wednesday, 7/16/08. The community clearly wants to find out what has happened to the taxpayers ink pen. However, serious questions are now mounting with regard to Mr. Smith's decision to not call in the SBI, FBI and National Guard.

Interim Town Manager Erskine Smith, the keeper of all ink pens, remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville due to his role in this matter as well as other matters that have been brought to light.

The town board has placed Helen Keller in charge of oversight of the ink pen location process (including but not limited to any investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which Helen Keller reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the missing ink pen.

2) Mr. Smith's direct recommendation to the town board that he chews on ink pens sometimes.

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching and hunting down the dirty rat that stole the ink pen.

4) Mr. Smith's involvement in a questionable commission in the amount of $0.32 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends steal taxpayers ink pens”, the contents of which have never been publicly disputed by Mr. Smith

5) Mr. Smith’s failure or refusal to change all the locks on the doors, filing cabinets and storage bins.

This is Day No. 4.

The ink pen guy's satire might be funny if that was what the story was about. Unfortunately, it is something much more serious. Ink pen's energy could be better spent having the guts to look into official corruption the way Gatton has done. Of course, he wouldn't have the moral fortitude to do that. Because he doesn't think what Gatton has exposed is wrong. This is the atmosphere in which corruption is allowed to thrive.

I don't have any relatives involved with this. I am SERIOUSLY saying, ABRAHAM did have a buddy involved with this water treatment plant. I think the public is forgetting that and while we are trying to clean things up, I am saying-VOTE HIM OUT next election to anyone trying to fight for open and fair dealing, above-board politics in this town.

9:29 am - you are sweet to make this comment. Jaime is a dear friend of mine and I can tell you that we have shared a laugh or two over the "welfare/food stamps" comment. I have a pretty good idea who is writing this and I understand their motivation. I can tell you that Jaime holds no hard feelings. Just for the record, Jaime decided to stay home with her beautiful baby when she had him two years ago, as well as her other two children. Her husband is a dear man and a wonderful provider for the family which has enabled her to raise her children while creating this blog which she has dedicated to the "silenced majority" of her town. Do not worry. No smear tactic and no name calling will deter her from her dedication to this effort.

In Living Color was a great show. But corruption isn't funny. Your police chief is entering the third full week of his suspension. Other officers have been suspended without pay and fired for much, much less than what has already been proven in this case. You might not like Tic Toc's style, but you know his basic point is right. Perhaps you should join him in simply asking for equal justice under the law. Nothing more, nothing less.
