Town's ethics code to get a second look

The Town of Mooresville adopted a Code of Ethics in 2005, but commissioners at the time failed to give the policy teeth.

That could soon change.

Mooresville’s new town manager, Steve Husemann, plans to revisit the town’s Code of Ethics, and at least two town commissioners hope to pick up where the 2005 town board left off.

Ironically, Miles Atkins – who was not a commissioner at the time – researched and introduced the idea of an ethics code to the town board in 2005, when commissioners – specifically Mitch Abraham and Alice Lee – were facing public scrutiny for their selection of engineering firm CH2M Hill to design the town’s multi-million wastewater treatment plant expansion. Abraham and Lee spearheaded the town’s choice of CH2M Hill but did not disclose that they were close personal friends with an official of the firm and attended his same church. The town board adopted the Code of Ethics on June 6, 2005. It also developed an "ethics advisory committee" to review the code and provide input and recommendations to the town board regarding the formation of a formal committee to oversee the code’s enforcement. Atkins and Chris Carney -- also not yet elected to the town board -- were appointed to the advisory committee; Atkins was appointed by Danny Beaver, who Atkins would eventually challenge and defeat in the 2007 at-large race, and Carney was appointed by Mitchell Mack, whose Ward 4 seat Carney won in 2005 when Mack chose not to seek re-election.

The advisory committee met four times over the course of four months. But when the group brought its recommendations to Mooresville’s town board in January 2006, commissioners took no action, essentially killing the advisory committee’s work. It also meant that the Code of Ethics had no approved procedures in place to respond to citizen complaints against elected officials.

Last week, Mayor Bill Thunberg asked Husemann to revisit the policy – along with all the other town policies, procedures and operations.

But Carney quickly zeroed in on the ethics code, saying that elected officials from other areas have found themselves in “inappropriate situations” and “that doesn’t leave a good taste in the mouth of the citizens.”

The Code of Ethics addresses several topics, including conflicts of interest; duties to recuse, disclose, and cooperate; unfair use of town property; misuse of confidential information; improper gifts and fair and equal treatment.

“So much work was done” by a “very non-partisan ethics advisory committee” in 2005, Carney said last week. “A lot of the footwork has been done, and we need to take the recommendations of that committee and put (the Code of Ethics) in action.

“There was a unanimous recommendation from the committee to form a vetting system for ethical complaints against an elected official,” Carney added. “Everybody agreed to the premise and the idea of it. There’s no reason in the world not to have it.”

Carney said currently in North Carolina, “there’s no system, short of a felony, of removing unethical elected officials.”

If an elected official is found to have conducted himself unethically, said Carney, “Citizens shouldn’t have to hold their nose, waiting for the next election cycle. There certainly needs to be something done about that.”

Atkins said that the town’s adopted Code of Ethics remains in effect. However, he said, “If someone filed a complaint today, they can reference a code, but there’s not a formalized process in place even though (the ethics advisory committee) recommended it.”

He said he expects that Husemann and commissioners will review the Code of Ethics and the advisory committee’s findings and, sometime in the near future, vote on virtually the same recommendations that were presented to the town board in January 2006.

“When there is lack of confidence or mistrust, this will be a tool for the citizens,” Atkins said.

The facts are the facts. Crone did somethign he shouldn't have done and he lost his job. If what he did was illegal he may loose some freedoms. It doesn't matter who knows who knows who knows who.

I am not 4;20, but i am with him/her. An active reverend with a grudge against the police chief, an investigative reporter with a close connection to both a commissioner and a fired police officer with grudges against Crone are not what I would call private citizens. They are in the public view and are considered public.

They are not public officials, but they are PUBLIC FIGURES. Just read the link Jaime provided on the home page.

They are not above scrutiny.

I was very involved in politics in my hometown and would like to be involved here. Could somebody please tell me who Cliff H. is? If he's been so instrumental in getting rid of the corruption here, I'd like to know who he is so I can join the group of "pawns". I don't mind being a pawn for a good cause. Too many chiefs and not enough Indians never worked any way.

My questions were related to Jaime's relationship to the police officer who was fired by Crone and to the commissioner Atkins who both have pretty deep grudges against Crone. I'm asking for that information. Jaime can feel free to post with a denial as this is her blog too. I've read several suggestions that the relationship is pretty close to both of those individuals with the grudges against Crone.

I've already commented several time on several threads regarding my motives and your allegations about what Frank said or may have said.

I've said it before and I'll say it again ... there was no documentation supporting the rumors you're repeating. What Frank might have said is, as Rader likes to say, pure speculation on your part. You might want to read up on Asperger's Syndrome, Spectrum Disorders, and Autism before you go labeling someone like that.

Regardless, for me that issue has nothing to do with this issue. I'm quite capable of delineating between the two unethical situations.

Whether you like me or not is also irrelevant and has nothing to do with this thread of discussion, though you're more than welcome to bash me all you wish. I believe someone even created a blog for the specific reason of bashing me. Have at it!

You read into me whatever you wish, however you with in order to fulfill whatever motives you have. There is nothing I have said which I cannot back up with documents, no matter how much mud you attempt to sling.

I wonder what the town would be like if you exerted this much energy into actually doing something productive and helpful to bring about transparency and open government.

I am resuming my "Count Up Vigil" of the number of days which pass from the day Cops For Kids scandal broke (7/4/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The Police Chief was suspended (with pay) on Tuesday, 7/8/08. He was terminated on 8/8/08. The community is clearly relieved and deeply grateful that Mr. Crone has vacated his post. However, serious questions continue to mount with regard to Mr. Smith's decision to continue paying Mr. Crone a salary for the intervening month.

Interim Town Manager Erskine Smith, Mr. Crone’s supervisor, remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville due to his role in this matter as well as other matters that have been brought to light.

The town board has placed Finance Director Maia Setzer in charge of oversight of the CFK process (including but not limited to any audits and investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which the Finance Director reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the nonprofit corporation known as Cops For Kids

2) Mr. Smith's direct recommendation to the town board to include the nonprofit corporation known as Cops For Kids into the town's general budget in the amount of $20,000

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching Cops For Kids prior to submitting his recommendation to the town board

4) Mr. Smith's involvement in a questionable commission in the amount of $237,151.50 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends gouge Mooresville taxpayers”, the contents of which have never been publicly disputed by Mr. Smith

5) Mr. Smith’s failure or refusal to change Mr. Crone’s status to “unpaid” suspension despite the surfacing of various contradictory statements made by Mr. Crone in the media since his suspension

6) Mr. Smith’s failure or refusal to fire Mr. Crone despite his assumed knowledge of the damning evidence presented in a Gatton Report articles dated July 22, 2008

7) Mr. Smith’s failure or refusal to insure that a complete financial audit is conducted and released of Cops For Kids records, despite the mayor’s assurance that this process had begun on July 8, 2008

8) Mr. Smith’s use of double standards when enforcing employment policies, as evidenced by his statements in the August 2008 “Town Voice”

9) The fact that Mr. Smith staunchly resisted firing Mr. Crone until after there was citizen unrest which resulted in a citizens protest on the Mooresville Town Hall on 8/4/08. The protest in turn brought about significant negative publicity for the town. Mr. Smith’s inexplicable delay in firing Mr. Crone therefore ultimately resulted in tarnishing the town’s reputation

10) Mr. Smith allowing his subordinate, Maia Setzer, to take multiple vacation weeks in the weeks following her being assigned the duty of supervising this process. His decision to do so has now unacceptably delayed the audit of the nonprofit organization known as Cops For Kids

I'm way behind on reading these comments but the one that was really rich was the one earlier somewhere telling us that the readers of this blog are a "laughing stock". Oh yeah. We really believe that one - right up there with "Crone's innocent" and "Deposit slip? What deposit slip? I never saw a deposit slip". You want laughing stock? Just look at the mug of a certain commissioner on the homepage. After that take a walk to Town Hall and peep into the now deaf/dumb/mute mayor's office. If you're still not laughing then stroll over to the mayor's buddy Erskin Smith's big fancy office which stays empty most of the time - your tax dollar hard at work. If you need more laughs go back and watch your former police chief stutter and stammer through simple reporter questions on TV (made us look just great). Want more laughs? Go and catch Commissioner Abraham at any of his favorite eating places and remember how he singlehandedly started good ole Wastewatergate, a snafoo we'll be paying for for years to come. I'd say somebody laughed all the way to the bank on that one. We've earned the regional name "Dirty Mo'" thanks to these funny characters. We're the laughing stock, alright, just not the way this particular poster was wishin'. He and his handful of crooked buddies are too busy laughing at this blog to notice that everybody else is laughing at them.

Personally I don't care how or why the CFK story got started. I don't care how ANY story got started. I'm just glad they DID get started. I was writing out checks every year to CFK and writing them off as a tax deduction. Now it looks like I could be facing an IRS audit. How's that fair? What does that have to do with who Jamie knows or who held a grudge against the polic chief? If that police office or council member held a grudge then maybe now we know why. I'm glad you brought that to my attention. From this point forward, that council member has my vote and instead of writing out a check for CFK, I'll write my "donation" to that person's campaign.

You make a very good point. There are those posting on here who are being put in a bind because of information that has finally been made public.

In an attempt to sway the focus, they have tried to make the whistleblowers look like the bad guys.

What started this, was the innappropriate actions of officials. What this ultimately is about is addressing those actions and removing those officials from their position.

I personally could care less about what punishment they recive. My contentment will be in their removal.

Whatever punishment a court applies is up to that court and of no concern to me. After removal, my next focus is the replacment of those persons with someone deserving of the trust of the public.

How this got started is irrelevant. The issue of dishonest officials is the purpose of this whole investigation.

I can understand witholding the results of the initial town audit pending the secondary audit and the criminal investigations that are on-going. However, it would be refreshing if the Town Manger would say something about when we can expect to know the results. I understand also that the SBI's investigation will be turned over to the DA's office and is not going to be available but when can we expect that to happen. When will the DA say yea or nay about criminal charges. These are not to much to ask. I also want some finality to the Cheif of Police position. Post the job and hire someone that will restore the community's confidence even if it is the current assistant chief. Its time to piss or get off the pot.

Taking the web site of the REAL Cops 4 Kids Charity was as calculated to deceive as you can get, his TRUE information would have garnered no raised money or very little.

People gave money based on that website and were deceived by it and gave money, included in the deceived is one of your town councilmen who put that deception in writing.

Lets see now, a false representation, might that be calling people or stopping by their business and telling them you need money for the DARE program to help teach and keep kids off drugs, and then turning around and using that money to by products that although have the DARE logo on them, also have the good sheriff's name on them instead of the department's name. Now that is not what he told people he would use the money for so yes that is a false representation.

Yup I would say that violates element one.

Well I am having a hard time with this one, because was it calculated and intended to deceive. Yup it was, he told people the money would go to help keep kids off drugs and that is all it can be used for. It does not take a genius to figure out that if he ordered the products and then continued to collect money then yes it is, and that covers him on element 2

Well people gave money and they thought it would go to help keep kids off drugs, it did not, it went to help the good sheriff's reelection campaign, that covers number 3

Look folks he is guilty and no matter whether he is a good man or not, he is going to prison. How many times can you repeat yourselves? It is certainly obvious why some of you continue to hide behind the screen of anonymity! It is not because you are afraid of losing your job! It is rather, you are embarrassed to have your identity known. You need to quit pretending you know what you are writing about, or, did you turn your middle school kids loose on the computer.

You make a very good point. There are those posting on here who are being put in a bind because of information that has finally been made public.

In an attempt to sway the focus, they have tried to make the whistleblowers look like the bad guys.

What started this, was the innappropriate actions of officials. What this ultimately is about is addressing those actions and removing those officials from their position.

I personally could care less about what punishment they recive. My contentment will be in their removal.

Whatever punishment a court applies is up to that court and of no concern to me. After removal, my next focus is the replacment of those persons with someone deserving of the trust of the public.

How this got started is irrelevant. The issue of dishonest officials is the purpose of this whole investigation.

They protected Smith by ostensibly taking this mess off his plate. Never mind that it is not lost on the rest of us that here’s a guy who wasn’t good enough to be given town manager after McLean left, and wasn’t good enough to be given it when Justice left, and wasn’t good enough to be in charge of the Crone mess. Sooooo, they propped up Maia Setzer, knowing (sigh of relief on their part) that she’s due to be gone for about a month straight and “Oh, dear me” can’t return calls or emails or whatever simple stuff you gotta do to keep audits and investigations rolling. Worse part? If it wasn't for this blog, their trick would have worked. As it stands, their trick is now a noose around their own necks tightening with the passing of each day.

Well, well, well, NUMB NUTS, since you seem to admire my husbands body part, I guess I can comment on yours. You and your ilk seem to be interested in our body parts. You gave me such a giggle. Are you jealous of his good looks, at 118 years of age, or are your sights only on his toush. I guess if it is the latter, I could call you a deviate. Hmmmm, I shall have to think about that.

Oh, another thought; are you jealous and afraid of his genius. He has proven he had the facts about the corruption, in the beautiful town of Mooresville, which entailed days and weeks of research at home and at the Town Hall. I’ll bet you could never have found the discrepancies, You wouldn’t listen and the lethargy of most citizens did nothing to support us. He still kept digging because he cared about the citizens and he could see where the Town was heading. He even had an interview with Garry Frank and supplied him with all the data he needed to bring criminal charges against some of the prior/present commissioner(s).

Well, Frank/Roberta (?) (whomever) have I said enough, to let you know how proud I am of my fearless and honest husband who gave up about 3 years of his retirement to fight for the citizens of Mooresville and regardless of where we live we will continue as best we can to help protect those same citizens.
