Code of conduct in the works for Mooresville's elected officials

Mooresville may soon have a code of conduct for elected officials.

Town Attorney Steve Gambill is drafting a policy that if adopted by commissioners would define the town’s ethical standards for elected government officials, Commissioner Miles Atkins said this week.

News of a potential code of conduct came less than a week after The Gatton Report/Mooresville Weekly exposed hundreds of intimate e-mails between Mayor Chris Montgomery, who is married, and a woman, who goes by Lisa Richards, Molly King and Grace King, that were discovered in a public records request.

A second public records request turned up hundreds more e-mails between the mayor and woman from July 5, 2010, to Jan. 3, 2011.

Atkins said the town’s ethics policy, which he spearheaded as a private citizen in 2005, “provides guidance on ethical issues and questions of right and wrong.” But the town has been lacking a written code of conduct for elected officials, he said.

Commissioner Rhett Dusenbury said the absence of such a policy gives elected officials latitude of use. However, Dusenbury said, “We are frequently reminded that this is public equipment, our uses should be discrete in nature, and (we should use) common sense.

“We have all been informed in different training classes that N.C. Freedom of Information statutes apply to the use of all public equipment and that our conversations/uses of public equipment are open to public scrutiny,” Dusenbury said.

Commissioner Thurman Houston said he thinks that could be one reason the town has never felt the need to consider a code of conduct for elected officials: Because those leaders should simply know better – or at least, he said, they’re trained better – than to behave in such questionable ways.

Commissioner Mac Herring acknowledged that “the mayor did not violate a policy.” However, he said, “Were his actions inappropriate, unethical and unbecoming of him as mayor? Yes. Do we need to come down hard on him about it? I think public opinion will do that.”

Commissioner Chris Carney said the town board “has nothing adopted that allows for us to censure anyone for this kind of action.” But “the mayor’s recent misconduct in office” has provided Mooresville with the opportunity to develop and adopt a code of conduct, which Carney said he would “support 110 percent.”

Codes of conduct for elected officials have traditionally been hotly debated; it’s anyone’s guess how the policy may be officially received by Mooresville’s elected officials.

But one thing on which they all agreed this week is that the mayor’s frequent use of public e-mail for private matters, in the words of Commissioner Mitch Abraham, “is very much inappropriate and unacceptable.”

Said Dusenbury: “I would have to say that as a constituent, taxpayer, (and) voter, I am disappointed in the mayor. We are given the trust of the public when we are elected, we swear to uphold the U.S. and N.C. Constitutions to the best of our ability, and we are expected to represent ourselves in the community accordingly.

“I really don’t care what the mayor of Mooresville does in his/her own home, but the fact that he voluntarily ran for office to represent the people of Mooresville as their public face and lead ambassador carries with it the responsibilities of a public official … a higher standard of conduct than the average taxpayer.”

Referring to the code of ethics he pushed for the town in 2005, Atkins said he lives by the same standards he applies to anyone else and “if in any capacity I ever abuse the position or authority graciously give to me by the people of this community, then I expect to be held accountable for it.

“As elected officials, we must hold ourselves accountable to the taxpayers and citizens of Mooresville by using public equipment solely for carrying out town business,” he said.

But the mayor and his wife have placed part of the blame for the mayor’s recent actions at the feet of Town Hall. Lisa Montgomery said she told her husband upon his election as mayor that “a lot of people in that town office … will stab you in the back as quick as you turn around.”

The mayor told Mooresville Weekly prior to last week’s story that he wondered if the report on his e-mail use was “politically motivated” and said: “I don’t walk away from the rumor mill – I run. At Town Hall, that’s all there is. There’s no one – maybe with the exception of Steve Gambill – that I can trust.”

Each and every town commissioner took issue with that this week. Houston, Abraham and Herring said Town Hall bears absolutely no responsibility for the situation.

“It is sadly unfortunate that the mayor feels this way,” Abraham said, adding that he is “deeply disappointed that I did not first hear about these e-mails directly from the mayor himself.” He said “the mayor is welcome to discuss his actions with me personally, face to face.”

Carney called the mayor’s statement about Town Hall “a terribly irresponsible comment” that was “even more irresponsible than the (the mayor’s) actions themselves.”

Elected officials, Carney said, “have to put politics aside and work alongside whoever the citizens put in place. We have no buddy system in place, but we do have an expectation of work ethic, and we expect the mayor to come in and do his part of the heavy lifting. If he has felt that he’s not been welcome, that’s probably because he’s not been able to get his part of the job done as of yet.

“We’re all trying to do our part, and it is improper for any particular elected (official) to insinuate that they’re treated with anything less than the respect of their office,” Carney said.

Instead of the story being brought on by Town Hall, Carney said, “This situation is a distraction brought upon the Town of Mooresville, the town board and staff by one person. None of us would have ever asked to be placed in a situation to have to comment on the character of an elected official.

“Nobody leaked this information,” he said. “Nobody was even aware of this information until the public-records request went through.”

Added Atkins: “My understanding is that all of this came to light as a result of the public records law that allows access to all government communications.

“I don’t care to speculate on blame, political motivations or who is to bear responsibility for this situation,” he said. “I firmly believe in and am committed to transparency and accountability in our town government. If any elected official or paid staff member uses publicly funded tools such as e-mail or cell phones to conduct private business, that is not in keeping with our responsibility to the taxpayers and citizens of Mooresville.”

Said Dusenbury: “I am sorry that the mayor feels the way he does regarding other commissioners and town staff, but he is an adult who makes his own choices, and this situation boils down to very bad judgement on the mayor’s part.”

Dusenbury said he is “not aware of any conspiracy to remove the mayor from office or to diminish his standing in the community. I would have to state that to the contrary, we have all given him advice regarding issues before the town, and he has exercised his own judgement when he had the opportunity.”

Regarding Town Hall responsibility, the office of mayor “has certain standards and responsibilities that come with it,” Dusenbury said. “These standards come in the form of adherence to North Carolina Statutory Law, ethical conduct, decorum and a moral component consistent with the accepted norms of our society, and (Mayor Montgomery) accepted these voluntarily and intentionally.

“We as adults should all weigh the consequences of our actions before we act … but regardless of whether we are a bad legislator, public speaker, etc., one of our first duties as elected officials is to avoid bringing disrepute on our community whether it be in deed or even in inference.

While I agree with the board members that the Mayor needs to pull on his big boy pants and take responsibility for his actions something does smell a little funny.

Perhaps our intrepid reporter just happened to file a Freedom of Information Request to obtain all of the Mayor's emails and got quite a story out of it.

I wonder if someone told Jaime that there may be some hijinks going on...and...since it doesn't sound like the Mayor was terribly discreet this could have been anyone who witnessed him and his friend.

So...it could be someone who wants the Mayor's job....or it could be someone who may have noticed a woman going in and out of the Mayor's office.

Or...it could be that Jaime routinely files FOIRs on town officials as an investigative journalist.

Hard to say.....

The Mayor screwed up royally and I don't care who blew the whistle or why. He was elected to do his job and he failed the public trust. Period!

I am thankful this came to light by whatever means. Don't you WANT to know what is going on, especially if you are paying for his actions?

4:53, it sounds like you want the background dirt. Go for it but don't diminish the absurdity and stupidity of our Major. He has lost our trust and is now a lame duck Mayor. The Commissioners have been lampooned by him, the people have lost faith in him and he no longer has any political clout.

Now this is what I call open, honest, accountable government. None of us in the community expect perfection from our elected officials. But we do expect openness, honesty, and accountability. And that is what I am witnessing right now. It is quite refreshing. Kudos to the commissioners for moving on creating a code of conduct for present and future elected officials of Mooresville. I for one am looking forward to reading the specific wording of this code of conduct, and it is my hope that it will be genuine and sincere, and not merely lip service.

Mr. Montgomery has neither this town nor his family's interest at heart. It is all about Chris all the time. He is, pure and simple, a repulsive human being.

It saddens me that grown people who run and are elected to public office should need a "Code of Conduct." Seems to me if you don't already have it, you can't legislate it. We aren't interested in someone's private life. Do us all a favor and keep it private!

8:20 you're right. Miles Atkins thinks he can jump in and be some sort of hero by writing a 'code of conduct.' What this bonehead doesn't get is that he won't solve any problems. No legislation is going to magically make everyone ethical. He is just doing this as a political move. But he's really just showing is stupidity.

Actually, 3:00 AM (what happen? bars close?), you're the one who sounds stupid. I'm a voter. I'm a taxpayer. My taxes paid for the little gadgets the HONORABLE mayor used to try and get into some woman's pants. I'm not so naiive as to think that a code of conduct's going to stop fools like this. But this much I know: if there's a code of conduct, at least the rest of the town board will be able to publicly censure such fools and reduce the chances of them quietly staying or getting back into office so that they can keep spending MY money for their own PRIVATE crap.

I was very glad to see that the rest of the board isn't trying to defend the mayor's misconduct. I agree with them. For me, this wasn't about the mayor's personal life. For me, this was about the mayor using public time and public resources for his personal life. It's good to see that his colleagues did not do what I've always seen done in town hall - circling of wagons. Good for them.

I am very confused right now. This Smith fellow does not appear to be very respected in the community, and he appears to inspire very little confidence in its citizens. But I read very glowing remark about him by the councilmen in the newspaper. Either he is being unfairly persecuted, or the animus against him is justified, and the councilmen are supporting him for reasons unknown. What is the real story?

Are we going to have an assistant town manager? If Smith is going to do both jobs for one paycheck there may be a positive here. I believe both of these are six figure salary positions.

As for our Mayor.....do we really need a rule that says "don't use government equipment to have an affair"? I think the voters will have their say about what they are looking for in November.

I have known the Mayor and his wife for years. I'm disappointed in them BOTH. Chris has always had questionable morals, ALWAYS. He has screwed his fellow employees over time and time again. Just ask anyone who has ever worked with him. He's always all about Chris. But LISA? She's known this about him. She's married to him. And what kind of woman defends him, stays with him, then blames others when all she has done is complain about his immaturity? They both need to grow up! Reporting the truth about something HE did on his own is not "back stabbing". It's called getting caught with your pants down. This is NOT the kind of man I want representing Mooresville. It begs the question, What else does he cheat and lie about? It goes to morals and questionable ethics. He fired several people at the paper for what he considered misuse of time and email. What a hypocrite. He has even told friends that he took office because he had just lost his job and it was an easy paycheck. Some leader! What a complete loser!

This garbage about Erskine Smith being a great and glorious person is a bunch of crap! His only qualifications for the town job was that he sold pants at Belks and his daddy was a close buddy of Joe Knox. Down through the years everything that he has touched has turned to mush. To name a few during his many years he was on the Fire Dept as a volunteer fireman and when the bell would ring he would vacate his desk and get in his town owned vehicle and chase the fire trucks and stand around talking while the firemen put out the fire he would then turn in a charge for driving to the fire and collect a 5.00 fee for driving the town vehicle to the fire obviously he was double dipping all the time - he now draws a retirement from the fire dept for these years of falsely being a volunteer fireman. Now about the golf course for many many years he never paid any golf fees or cart fees for using the golf course just like Joe and Lib did. If he was needed you could only find him on the golf course. Then comes the fiasco of the embezzelment at the Lib rary - cleaned up on that one, now comes the problem at Police dept and the money problem with Chief who was fired and yes good ole Erskine helped in that one, and it goes on and on. There are many more areas that he has fed at the municipal trough down through the years. Oh by the was he also has the town pay for his clothes. And the town board wants to talk about what a great guy he is.

Sadly it appears that the mayor is in love with someone other than his wife. Life happens but for this to be exposed so publicly must be incredibly painful for his family. I agree with 549 that his wife should realize that sometimes it isn't in the best interest of the children to continue a relationship that isn't working.

Erskine Smith is the last remnant of the political patronage system that plagued Mooresville politics for many years. That system eventually created great upheaval and citizen unrest. To appoint Smith as the town's manager is to invite a resurrection of that system and therefore a resurfacing of the tensions and disharmony which beset our town in recent years. Please initiate a proper search for a proper town manager.

I don't know what we're paying Erskine Smith but I know that we were paying Steve Husemann something in the neighborhood of $120,000 a year. I've heard the assistant manager is 6 figures as well, but I couldn't give an accurate figure.

Which brings to mind. That's a lot of money. Someone in one of the other blogs mentioned an idea I thought was good. What if we cut those salaries in half and just make the mayor a full time job with a full time salary?

Are we saying there are no policies in place for personal use of Town assets by the Board or the Mayor? So any of them could take a town asset home without authorization or use the asset on the job for their own personal use?

What am I missing?

What would a Commissioner or Mayor have do to be relieved of their post? Surely there are rules of conduct already in place!

I do not agree with what the Mayor did. However would a code of ethics really be any good.
Look what we have a councilman that would do anything to be Mayor possibly even letting his neighbor know about the e mails to help his own cause. Is it right that his wife gets a easy high paying job with the Downtown Commission. How does Commissioner Carneys brother get a big job with the Chamber of Commerce. There has to be something with an odor here.How about the finances of ome of the commissioners, how many have a bankrupcty on their credit record one of them does.
You will not see Ms Gatton checking on any of this because of her friendship with at least two of them that has been written about in this post.

Who cares WHY anyone did what they did?!!! Here's what it comes down to: Stop indulging in immoral practices!!! Be honest, live your life right, don't participate in corrupt behavior then try to hide it.... and so on. Then there won't be anything to speculate, tattle about, report, or back stab. Geez, folks, are there any ADULTS running the show? Of course people make mistakes, but most are accidental or without being completely informed. What these people did was intentional and knowing. They do it for their own gain. Do you think Mr. Montgomery would have admitted anything to the taxpayers or his wife if he weren't caught? Of course not! Reality check! He'd still be carrying on. His morals haven't changed. Same with all the other officials. No one is sorry about who they are or what they've done. They're only sorry they were caught.

UNIFIED GOVERNMENTS, SANITARY DISTRICTS, AND CONSOLIDATED
CITY-COUNTIES TO ADOPT A CODE OF ETHICS FOR THE GOVERNING BOARD
AND TO REQUIRE THE MEMBERS OF THOSE GOVERNING BOARDS TO
RECEIVE EDUCATION ON ETHICS LAWS APPLICABLE TO LOCAL
GOVERNMENT OFFICIALS.
The General Assembly of North Carolina enacts:
SECTION 1. Article 5 of Chapter 160A of the General Statutes is amended by

"Part 3A. Ethics Codes and Education Programs.
"§ 160A-83. Local governing boards' code of ethics.
(a) Governing boards of cities, counties, local boards of education, unified
governments, sanitary districts, and consolidated city-counties shall adopt a resolution or policy
containing a code of ethics to guide actions by the governing board members in the
performance of the member's official duties as a member of that governing board.
(b) The resolution or policy required by subsection (a) of this section shall address at
least all of the following:
(1) The need to obey all applicable laws regarding official actions taken as a
board member.
(2) The need to uphold the integrity and independence of the board member's
office.
(3) The need to avoid impropriety in the exercise of the board member's official
duties.
(4) The need to faithfully perform the duties of the office.
(5) The need to conduct the affairs of the governing board in an open and public
manner, including complying with all applicable laws governing open
meetings and public records.

Typically the Town Charter establishes the form of government a town or City will operate under. It is clear that Mooresville has a Council/Manager form or government where the Citizens elect a mayor and town council and they in turn hire a professional manager to run the day to day operations of the Town. All Town employees work for the Manger and he has hiring and firing authority.

The only person the Council can hire and fire is the Town Manger and it takes a majority of the Council to do either.

The only way to remove an elected council is if there is a legal method in place. I do not know of any State level method for the removal of a Town Council person from office and unless there is something in the Town Charter (and I doubt there is) we are stucl with the Mayor until such time as the voters remove him from office. I remember several years ago a bible thumping county commissioner in Cabarrus County was arrested for solicitation of a hooker in Salisbury and he remained in office until he decided not to run again because there was no legal way to remove him from office.

A simple search of the documents on the Town of Mooresville website shows the Ethics Policy was approved June 6, 2005 and has been updated since. Code of Conduct is different.

I'm pretty sure that that was pointed out by Commissioner Adkins in the article. Pretty convenient for anyone that is convinced that this is just for show I guess to miss that part.

Word’s circulating around about Bumpkin (oops, I meant Erskine) getting the town manager gig and the groundswell’s begun. If he’s kept on be looking for some commissioners to get their walking papers come November. As somebody already wrote above the town manager is the only person they can hire or fire. So if we're stuck with him then the onus is on them and them alone.

Just to set the record straight for 7:48 and 4:36 and everyone else.The Town Council can fire only THREE PEOPLE, The City Manager, The Town Attorney, and The Town Clerk which is Ms Janet Pope. They cannot fire Ms Pope from her job as a Secretary/Adminstrative only from her position as the town clerk.
One thing they can do is to appoint Erskine the Town Manager and then they have the authority to fire him. Great idea to me.
