Drug suspect calls sheriff; dodges charges

Iredell County Sheriff Phil Redmond is widely known for his "war on drugs," thanks in large part to his officers’ impressive drug-busts on Iredell’s two interstates. 

But how about Redmond’s “war on drugs” in our backyards?

Five years after Redmond was first elected – and the same year his deputies seized $6 million in drugs, according to the sheriff’s webpage – the sheriff's office did not file charges against a man who two deputies arrested for manufacturing marijuana in a Statesville backyard.

The sheriff may have had something to do with that, according to the reporting officer’s narrative in the 1999 police report.

According to the report, the two officers received information about marijuana plants growing in a garden owned by Christopher Davidson. Upon arriving on the scene, Davidson gave the officers consent to search his property. During the search, the officers located seven marijuana plants growing in pots in Davidson’s garden.

According to the report, when the officers called Davidson back to the yard and asked him about the plants, "Davidson stated he had already called Sheriff Redmond at the office and that we could not charge him with the plants."

When the officers explained to Davidson that he could, in fact, be charged, Davidson responded: "Fuck it, it wouldn't stick." To read the full narrative from the police report, click on the document below.
Then nothing. Zip. Zilch. Nada. No court records, nor any other documentation, showing that Davidson was ever charged for manufacturing marijuana. A cursory review of Davidson's court records, in fact, turns up only simple traffic violations.

So did Sheriff Redmond himself truly talk to Davidson on the phone that day? Did Sheriff Redmond himself truly embolden Davidson to tell his deputies not to charge him for manufacturing marijuana? That's anybody's guess. Redmond didn't respond to Report questions this week asking if he recalled the conversation alleged by Davidson and referenced in his officer's police report. We also left a message for Davidson, but he did not immediately call back. As soon as we receive comments from him, we’ll post them.

We asked Sheriff Redmond if he, in fact, assured Davidson that charges could not or would not be filed against him or that charges wouldn’t stick if they were filed. Redmond did not respond.

We asked the sheriff to confirm that Davidson, in fact, was never charged. We asked him if “manufacturing of marijuana” is a felony charge and if the State of North Carolina has a statute of limitation on felonies (i.e. can Davidson still be charged today for something that happened in 1999?).

We also asked Redmond if he ever instructed, requested, encouraged or in any other way indicated to his officer(s) that they not file charges against Davidson – and, if so, why. We also asked Sheriff Redmond if he is personal friends with Davidson and in what capacity he knows him.

But Redmond did not respond.

The sheriff’s office vice/narcotics unit reported $14.6 million in seized drugs and $276,000 in seized cash in 2009 alone. Working with local, state and federal law enforcement agencies, the vice/narcotics unit “utilizes undercover operations to identify and arrest individuals that are involved in prostitution, illegal gambling as well as the distribution of illegal drugs.”

When I was first directed to this site I was skeptical. However, the more I read and see the more I understand why so many people are upset and demanding answers.

I was still waiting for the Sheriffs video proof from Linconton to be posted. Now I would like to see some answers on this as well.

I think that the key to this is curtilage...I mean am I responsible for what my neighbors do? Besides, the officer, if he felt such a "strong" conviction, could have charged him. Last time I checked, the sheriff doesn't sign off on officer's charges.In addition....have you verified that Davidson even called the Sheriff?? I mean, if you are an investigative reporter...INVESTIGATE!! Besides, if I were the Sheriff, I wouldn't spit on you to put out a fire!! Much less talk to you...I mean you wouldn't respond to him.... The investigation starts with the source and according to the report, the source is Phillip Redmond who apparently had time to respond and stop this whole thing before it started.

Fair journalism begins with contacting the accused. That is what was apparently done here. The accused has no comment, so all of the questions remain.

He wanted Jamie to drive to his office to see a video that is public record, but he won't respond by email while sitting on his fat gray headed ass? That is the Phillip Redmond that those who work for him know and the public is now seeing. It is elected Sheriff Redmond not reigning King Phillip. I believe he misunderstood the position.

Oh and the allegation about the other Phil didn't come with the documentation that everyone kept asking for. Well you got it and now you are mad. Just like Redmond you can't be happy unless everything is going exactly the way you say it should go. Reality and Redmondland are starting to collide.

He is traveling on that same road as Gerald Hege from Davidson Co.... Just wait and see. Jamie Gatton has exposed some real problems in local government. And she has done so just by asking questions. Im Detective Harris referred to in this report who accompanied the investigating officer involving the marijuana plants. Obviously a incident that occurred 10 yrs ago involving a few marijuana plants would be hard to remember all the details. But one thing I will say, In my 15 yrs working at ICSO all of which assigned to Narcotics I have never been told by the Sheriff nor his administration to not arrest anyone! Could it be Mr Davidson wasnt arrested cause the true story is that the investigating officer felt the marijuana was located in a place (curtilage as referred to in the report) where he couldnt be charged such as somewhere off his property. If the plants werent on his property then he shouldnt have been charged. Secondly not all cases involving drugs are the offenders arrested. Not saying thats the case with these marijuana plants but sometimes drug offenders provide substanial information leading to the arrest of other criminals engaging in illegal activities. In those cases the offender is given consideration for their assistance. In the future I suggest that in cases like this not to put peoples names in the newspaper in case they did assist Law Enforcement placing their life and family lives at risk. This comment is not intended to defend anyone but to just relay the facts pertaining to this situation and stop some of the wrongful comments placed on this blog made about innocent people. Because I will tell you I would not ever participate in any cover up and neither have I been asked to!!!!!!!

As usual the responsibility for actions has been shifted to the investigative reporter and not the elected official who needed to answer the questions. Redmond is the reason for the article, not Jamie. Had she left out the name she would have been accused of not providing information and starting rumors. As usual "Sheriff" Redmond takes responsibility for nothing.

You consider 7 plants "a few" marijuana plants. If you were to write one of the famous Phil said press releases, how much would those 7 plants be valued at? Maybe $2500 each? That would be $17,500 if it was somebody that the Sheriff didn't know. Front page; look at me, I'm the great Phillip Redmond. Yep.

You suggest that maybe the plants were located off of the property. The narrative says that they were located in the curtilage of the property. Are you telling me that after getting back to the office everyone had a better view of the garden and decided that it was not on the curtilage? I trust the decision made while still on the property myself.

Curtilage: The area, usually enclosed, encompassing the grounds and buildings immediately surrounding a home that is used in the daily activities of domestic life.

A garage, barn, smokehouse, chicken house, and garden are curtilage if their locations are reasonably near to the home.

The report states that the garden was 30-40 yards from the suspects house. That would be about 30-40 steps for the average person. Not very far.

As for whether or not information was given that resulted in dropping of charges, I don't know and certainly don't want it to be said. One overriding factor is that the suspect said he called the Sheriff and said he couldn't be charged and also f**k it, it wouldn't stick. That sounds to me like someone who had no intentions or need to cooperate with authorities because he had a free pass from the top authority already.

I noticed that you began your response by saying that you have never covered up anything and you ended it the same way. Nobody accused you of doing so. If you were accused or suspected of doing anything, I believe you would have gotten a chance to explain like your boss did, so relax.

Detective Harris. I noticed the first thing pointed out is that this was 10 years ago. That was bound to be a reason brought up to invalidate this. Keep in mind that this is not the only incident, just one that was not buried. Any activities which end up qualifying as Obstruction of Justice are Felonies and have no statute of limitations. There were incidents before this date and there have been incidents since then.

You have always worked hard and done a good job. Be careful that you don't involve yourself any more than you have to in defending others. The predicament you are in is understood, but you have always maintained a good balance between right and wrong. I hope you continue to do so.

Mooresville man facing felony marijuana charges

A 27-year-old Mooresville man was charged with felony marijuana counts after deputies acted on information from an anonymous source.
Sheriff Phil Redmond said Lt. D.E. Summers received information on Feb. 13 from an anonymous source that marijuana was being grown at a residence on Estes Park Drive, Mooresville.
Summers and other deputies went to the house and spoke with James Blue Anderson, who said he owned the house, Redmond said.
Redmond said deputies smelled a strong odor of marijuana when Anderson opened the door, and after some conversation, they received the OK from Anderson to search the residence.
Small amounts of marijuana, along with lights and other materials used to grow marijuana, were found throughout the residence, Redmond said.
A small amount of ecstasy was found in a subsequent search of a safe seized from Anderson's residence, Redmond said.
Anderson was charged with felony possession of Schedule I, manufacture of marijuana, maintaining a vehicle or dwelling to keep/sell controlled substances and possession of drug paraphernalia.

Now if you notice there is no mention of plants being found, only a small amount of marijuana. But because he had grow lights and "other materials used to grow marijuana" (probably potting soil and pots) he was charged with manufacturing marijuana.

On the other hand you have somebody actually growing plants and suddenly they are just "a few" plants. Also no charges are filed. War on drugs my ass. More like a battle for votes and kickbacks.

The Sheriff seems to have a lot to say when he is pumping his big head up by taking credit for his officer's hard work. Too bad he doesn't have anything to say when he is asked about himself or his inner circle.

Try and find out who backed his campaign in his first time in office! I heard it was someone in the North end of the county who is one of the biggest dope dealers in the county!!! And funny how when doing interdiction in the North end of the county we get approached by the Great Phil Redmond and he takes the lead officer for a ride in his bat mobile and 20 minutes later we are told to pick up and go to the South end of the county and play all this at around 10 to 11:00 PM!! And yes you will ask were you there and I can say yes I was one of those deputies !!!! And I think Redmond was in his Playboy Smoking apparel like he had his estate the PLAYBOY MANSION!!!! I just wonder does Jamie believe that that the voters of Iredell County are this ignorant. I have followed several of the articles on this site, and have noticed that it seems it is nothing more than a witch hunt and has been that way every time Mrs. Gatton gets someone in her crosshairs. The last story was about a video. Redmond made it clear I have the proof come and look at it, but did Mrs. Gatton go? No she demanded it and when it was made available she turned her nose up and would not at least go look. She is the one that asked the Sheriff he has no obligation to go chase her down and say “please here is what you wanted”. I believe that the Sheriff made it clear ANYONE could come look at the evidence, but no everyone just wants him to put a mans picture up to be beat down on this site.

As for today’s article, if I was the Sheriff I would not respond to her, he answered everything last time, made information available and she would not even give him a phone call. This time did you ever see her try to call? The Sheriff owes Mrs. Gatton nothing she will twist whatever he says.

Here are some facts that was left out of this article.

The reporting officer that day was Chris Owens, who left to pursue other interest. He now works for Coy Reid at the Catawba County Sheriff’s Office.
Mr. Owens has also written a letter of endorsement on the Mark Nicholson for Sheriff web site, sounds like there is an alternative motive.
Ask anyone at the Sheriff’s Office of their opinion of Mr. Owens.


Another fact had Mrs. Gatton done some calling she would have found that the way officers get to bust drug dealers is by using the smaller ones, and a lot of times because of the information they provide they are not charged. If this information gets out there could be extreme danger because of retaliation, but Mrs. Gatton never thought of this. That is why only parts of a report are released by law enforcement.

The Iredell County Sheriff's Office has arrested two suspects and is seeking two others in a series of pharmacy robberies spanning several counties.

All four suspects have been charged with robbery with a dangerous weapon, two counts each of second-degree kidnapping, and felony larceny in connection with a Dec. 30, 2009, robbery of North Iredell Pharmacy in Union Grove. They are also suspects in at least three other counties, the Iredell Sheriff's Office said.

Michael Ennis, of 409 Maverick Trail Drive, King, and Reece Eugene Tilley, of 390 Oak Summit Road in Winston-Salem, have been arrested. Authorities are looking for Danny Wade Lampley, of 7719 Tucker Road, Walnut Cove, and Bobby Joe Tilley, of 2745 Crosswinds Drive, Winston-Salem.

In the North Iredell Pharmacy robbery, employees told deputies that two armed men came into the business just prior to closing and forced them onto the floor, then tied them together. The men stole a large amount of narcotics from the pharmacy. They also stole an employee's car and firearm.

Deputies found the car abandoned a short distance from the pharmacy and determined another car had picked up the two robbers.

After a similar robbery in Winston-Salem on Feb. 22, investigators identified the suspects. Authorities issued warrants for the four suspects last week.

STATESVILLE, NC - A fourth person has been charged in the 2008 murder of Theodore Barbone, 18, of Statesville.
Jeffrey Montreal Nichols, 23, of Statesville, was charged Tuesday with first-degree murder, robbery with a dangerous weapon, first-degree kidnapping and conspiracy to commit robbery with a dangerous weapon.
Jeremie Labrandon Stevenson of Statesville was convicted in connection with this case and received a life sentence in December 2009.
Two others, Joshua Wayne Hemphill and Amos Katrone Johnson, both of Statesville, face the same charges as Nichols and are awaiting trial.
Barbone was shot to death in March 2008 and his body was left on Cool Springs Road.
Iredell Sheriff Phil Redmond said the charges against Nichols are the result of information that came out in Stevenson's trial as well as interviews since that trial concluded.
Detective Sgt. Errin Jenkins said the four were involved in a conspiracy to rob Barbone of marijuana.
Hemphill, he said, agreed to buy marijuana from Barbone on March 2, 2008.
All four, Jenkins said, conspired to take the marijuana and not pay Barbone for it.
Hemphill and Stevenson, trial testimony revealed, picked up Barbone on March 2, and one of the two pulled a gun on him.
Barbone struggled with the suspects and was shot and killed, trial testimony indicated.
Jenkins said Johnson was driving a second vehicle, following the one containing Hemphill and Stevenson.
During trial testimony, it was revealed that Nichols was also in the car with Johnson, Jenkins said.
After the trial, Jenkins followed up on that testimony, and through other interviews, Redmond said, determined Nichols was involved in the robbery planning.
Nichols is incarcerated in the N.C. Department of Corrections on charges of possession of drug paraphernalia. He was convicted of the charges Jan. 27 and sentenced to eight months.
Hemphill and Johnson are still awaiting trial on the charges. Assistant District Attorney Mikko Red Arrow, at the conclusion of Stevenson's trial, indicated the two will be entering pleas in the case.

Anyone who knows Detective Harris' professional stance would know that his response to "I'm going to call the Sheriff and he'll tell you that you can't arrest me" would be "Is that so? Because you'll have to figure out how to do it in handcuffs from the back of my car."

There is a reason that all police reports aren't made public. It pertains to safety, investigations, and ultimately helps to build better cases. One drug dealer always knows another and another, and once arrested, if the drug dealer in question is willing to cooperate, the outcome of the cases are ALWAYS very different. It could mean a lifelong prison sentence, a slap on the wrist, or a committment to be a long-term Confidential Informant.

There was only one single piece of reporting presented here, and it was a clip of a police report presented by someone who not only no longer works for the ICSO, but who is also a strong opponent of the Sheriff. There are alwasys two sides to every story, and to insinuate that there was corruption taking place based on this minimal information is ridiculous, at best.

Maybe the Sherrif didn't want to comment because he doesn't have the first clue about what went on with this case. It was over 10 years ago. I can barely remember what I did at work last week, let alone recall the specifics of what most narcotics detectives would consider a minor case that took place a decade ago.

For what it is worth, I am a civilian (not a member of law enforcement) and I do not have a dog in this fight.

Anyone who knows Detective Harris professionally knows that his response to a suspect who says, “I’m going to call the Sheriff and he’ll tell you that you won’t be able to charge me!” would be, “Well, you’ll need to figure out how to do that with handcuffs on from the back of my car.”
There is a reason that all police reports are not made public. There is more that goes into each and every case than the 10 or 12 sentences that you see posted on this website. Every case is different and the outcomes of each case vary just as much. Charges and therefore sentences can range from life in prison, a slap on the wrist, to a long-term commitment to be a Confidential Informant who ultimately helps build a bigger and better case. Unless you know the details of each and every case, there is absolutely NO WAY to know what all went on. Who’s to say this suspect didn’t become an informant? If that is the situation, they remain confidential for a reason and no one would tell you such just because you were fishing for a blog report.
To insinuate that there was corruption taking place off of this snippet of information is ridiculous. The officer who provided said information not only no longer works for ICSO, but he is also a vocal and adamant opponent of the Sheriff. Smells fishy to me…
As for why the Sheriff didn’t respond? Only he can answer that. Maybe he can’t remember the details of this case! Does your boss know every single move that you make? Mine doesn’t. Not only that, but this took place over 10 years ago. I can barely remember the details of my completed tasks at work on Monday, let alone what I did on a job over a decade ago.

This is in response to the person who asked, "why did the sheriff not respond to Jamie and clear this up before the man's name was on this site?" First of all, a successful public servant, such as a sheriff, mayor, governor, etc., doesn't have time to answer the stupid questions or address the stupid concerns of every loon they represent. And it should be obvious to readers of this blog that there are lots of loons out there who are gullible and/or ignorant enough to believe everything they read or hear.

Typically these are people who can only feel good about themselves when they are trying to tear down those they perceive to be superior to them. I've witnessed these poor pathetic people all my professional life. They spend their days trolling for gossip, the more bizarre and outrageous the better, and then take great pleasure in spreading the gossip as the truth. After reading Jamie Gatton's comments over the past couple of weeks, I would put her in this category and certainly NOT in the category of journalist.

Secondly, why would the writer assume that the sheriff owes Jamie Gatton the time of day. I'm sure he doesn't really give a flying flip what Ms Gatton or her groupies think.

Finally, responding to such ridiculous charges would only lower the status of the accused to that of the accuser, and as a result, would encourage other fools to make up similar accusations. If a leader breaks down and responds to one, they are encouraging every other kook out there to get in line. That's why the President doesn't lower himself or the office by responding to international crazies (well at least most presidents).

I respect a public servant who is smart enough not to run around wasting his/her time trying to appease every idiot looking for attention. I hope Sheriff Redmond will ignore the Jamie Gattons of the county and focus his attention locking up bad guys.

There are those that know how the inner wokings of a narcotics investigations goes, and choose to "muddy" the waters. I would hardly call this a "serious rumor" but instead speculation about the outcome of a drug investigation conducted over a decade ago.

Not every investigation leads to an arrest and/or charges. Period. Anyone with even slight knowledge of our justice system knows that.

I do, however, think that the people who are name calling and insulting Ms. Gatton are doing themselves a disservice. They are discrediting their own points-of-view, making themselves look childish and ignorant, and only pointing people further in the opposite direction.

I appreciate Jamie taking the time an effort at no pay and especially knowing her charcater will be challenged and belittled to inform us of facts. Many Redmond supporters have hollered for a week or so show us the facts ! Show some proof. Well someone obviously had some facts. I do know both investigators very well involved in this case. At one time I considered Harris to be a close personal friend. Owens is and will remain what he is. I find it funny that some have attacked his character here. Knowing full well he is a ranking deputy in another county no longer involve in these cover my assets and I will cover yours nonsense. I am angered by the "pro" Redmond posts here attacking the integrity of most everyone involved. Yet at the same time they brag of working for a wonderful man with no mistakes. I for one voted for Redmond in all his re-election bids. I think he most definately is a pleasurable personality that is the political King of this county. I think he has made some serious mistakes in his tenure as sheriff. I think several of the posters here posting anonymously have also made some serious errors. I am sure that Redmond will if not already wishes he would have just said "Hey, I have done my service and will collect my retirement and move on before the facts discredit me and embarass my rein of sainthood" As H. Miller once said, " No one is a perfect sheriff. And after 12 or 16 years you will have stepped on enough toes and made enough mistakes that will cost you any peace you would have had in retirement? I think it admirable that Redmond states "I have to run or my top people will not have a job"
Well I think both opponents have said "unless an employee is convicted of crime(s) everyone will have a job." Is Redmond making this same statement? His followers unfortunately are follwing their hero's footsteps : Tear their credibilty down so no one will believe them !! I am glad to see there are several credible candidates running this time. I will no longer support a criminal or his henchmen. So all of you staff people posting know that I do have a camera in my business with audio when you come in wanting a donation or wanting my influence with my customers. I have checked and will forward from this date any eveidence of you doing these things on county time or while wearing your badge and gun in case you say you were on lunch. It is illegal to solict me for your boss. He sure as heck does not ask himself as you all have visited first to make sure it is ok for him to come and Thank Me.

Okay, evidently 99% of the people reading this don't know Jamie or anything about her. To start with I was raised with Jamie in the same Church until we were teens...
I know Jamie as a reporter, and I know she has something you eejits who are to stupid to tell who you are...she has integrity! I hate to tell you this, but Jamie is a SEASONED reporter, and not a WANNABE...so do your research and get a clue.
Your insults to Jamie and "The Gatton Report" will get you no where, except to let people like me know how dim you actually are.
