A few questions for Commissioner Rader

In a couple hours, Commissioner Frank Rader plans to meet with a group of folks who are still scratching their heads over the at-large commissioner’s recent “presentations” to police officers amid several investigations into former Police Chief John Crone and his Cops for Kids program.

The meeting will be held tonight from 7-9 p.m. at the Mooresville Public Library.

Rader says he’ll allow each person one minute to ask a question – and he’ll require that the “questioner” provide a name and town of residence. He has said he wants “simple questions” for “simple answers.”

The following questions may be too complex for Rader – and they’d certainly take up more than one minute. But they are some of the questions that I hope people will ask the at-large commissioner … and I hope Rader will answer:

1. Did you address Mooresville police officers? When? Where? And why?
2. What did you say to the police officers? What information did you provide? What opinion did you provide about John Crone?
3. Why do you believe it is appropriate to address town employees amid multiple investigations of a suspended police chief?
4. You seem to suggest that absent criminal charges or conviction, town employees should not lose their jobs. Do you believe that a town employee should be eligible for termination only after they’ve been criminally charged and/or convicted? What about non-criminal conduct? Particularly for department heads, what is the standard for losing their job?
5. When is the first time you saw the deposit slip showing that money had been moved from the police department evidence room into Cops for Kids? How does that deposit slip qualify as “speculation”? Isn’t it evidence?
6. You and Mayor Bill Thunberg have repeatedly stated that you want to “wait for the facts” regarding Cops for Kids. Yet, the media and private citizens spent days pouring over the Cops for Kids records. While you were stating that you were content to wait on the facts, what steps were you taking to find the facts?
7. Along those same lines: Mooresville’s police chief has been fired and several investigations – including one led by the State Bureau of Investigation – have been called because of the financial problems that the media and citizen activists found while scrutinizing the Cops for Kids records. Yet, you take cute jabs at those citizens, calling them “investigattons” and “corruption folks.” Do you applaud them for their work? Do you believe they made a valuable contribution to our community, or are they just muckrakers? Why or why not? Do you believe it’s good for citizens to be involved in their government, or would you rather them sit down and shut up while you run the show your way?
8. Regarding the anonymous letter that was written to Crone: Why have you credited that letter with launching the Cops for Kids inquiry? The review of the Cops for Kids records uncovered significant mismanagement and possible criminal conduct. So, where does the anonymous letter fit in? In your mind, does it somehow explain away everything – or anything – that has been uncovered and exposed?
9. Why, in your “Rader At-Large” e-mails, did you include letters of support for Chief Crone but leave out letters that were critical of Crone or supported the investigations into his handling of Cops for Kids?
10. Have you ever requested anyone to give money to Cops for Kids? Have you ever accepted money for Cops for Kids and turned it over to anyone handling the Cops for Kids money?
11. In your “meetings” at the police department, you reportedly told officers that Crone’s story about Cops for Kids was the only one that “makes sense” to you. Do you still feel that way?

And while Commissioner Rader is on the record, perhaps he’d answer these questions:

12. Why does the Town of Mooresville use Windstream instead of MI-Connection for its Internet Service Provider?
13. The Mooresville Golf Course has been praised by the government for turning itself around and pulling itself out of the red. But if the town put groundskeeping back into the golf-course budget, what would be the net profit or loss at the golf course?

Several posters already seem to be on to this, but guess what people, the Mooresville Golf Course is the Golden Goose for people like Frank Rader, Erskine Smith, Mitch Abraham, and their friends, families and cronies, too. It wasn't just the police chief's Golden Goose for his Cops For Kids. It goes much much deeper than that.

Rader likes to tell himself he is into “facts” while the rest of us are into “speculation”. Well, what’s missing in his Rader Math Equation is a little something called “common sense”. Is it “speculation” that the sun’s gonna come up tomorrow, even though it is not yet “fact”? Or is it just “common sense” that it’s gonna come up?

Is it “speculation” that the police chief is probably corrupt when we’re looking at a piece of paper that tells us (and Rader and Smith and Thunberg) that Crone was playing footloose and fancy free with police evidence room money and CFK money? No. It’s just plain “common sense”.

Is it “speculation” that Erskine Smith is good for nothing more than covering up for crooks and a waste of my hard earned tax dollars? No. It’s just plain “common sense”.

Is it “speculation” that Frank Rader, while perhaps not actually corrupt himself, enjoys enabling and protecting corrupt officials? No. It’s just plain “common sense”.

I applaud the Mooresville Town's handling of the golf course. I get to play golf at a decent course, close to home for a decent price and everyone in town gets to help me pay to play. Aren't government owned private industries grand! Now I hate this MI connections public owning private deal because I don't use MI connections basically because the service is inferior to direct TV, and it always will be, but that's another comment all together! I dropped that MI service the day I knew my local government was taking it over. Oh and I picked up Windstream for my high speed internet just like the Town Government uses. They got that one right. What was the Town’s comment “We’ll always use Windstream vs. MI for our internet because reliability is important” or something to that effect. (Warning: sarcasm throughout)

Commissioner Frank Rader claims that he sends his Rader-At-Large to over 1,800 people. That list, as well as any of his town-related correspondences, is a public record. Has anybody considered requesting that list from him? Under N.C. law he must provide it if asked. I cannot ask for reasons I can't say.

7:37 YOU get to play golf at a decent price, but heck, if you're one of the crooks in this town you don't have to pay at all! As a matter of fact you don't have to pay for carts or balls or golf clubs neither. What's more is your little darlings or your wife or your mother or your friends don't have to pay either. they can just wink and nod and tell Charlie Roberts who they know and they're in! Then when times comes for THEM to look the other way, they're more than happy to oblige! Works like clockwork. One big happy Family.

Jaime, another fabulous job. This is an astounding list of questions. I am not even Commissioner Rader, and my ears turned red as I read them. I was especially struck by this question: "11. Pleeeeeease tell me a commissioner did not actually say that the only person making sense here was our very, very corrupt police chief. This is going to give me nightmares. Crone may be gone, but this commissioner is still here, and I now consider him very dangerous to the welfare of this community.

The Rader "discourse" was attended by about 20 individuals. As was expected, Mr. Rader's presentation of the budget took over an hour(remember, he claimed the budget show was just a tool to allow late-comers to not miss anything). Mr. Rader spent a good portion of his time dancing around questions and not providing much in the way of gravitas.

I did not learn very much this evening other than the fact that Rader can dance really well. Just off the top of my head, this is what I recall being discussed:

1. Rader did speak at roll-call of the PD because "morale" was low and he wanted to say "Keep up the good work." He could not rationalize why he presented the anonymous letter to the officers.

2. Mr. Rader thinks it is his right as a commissioner to speak to employees gathered for staff meetings, but says that he has nothing to do with personnel matters.

3. When asked why he would provide advice to officers regarding personnel policies, he moved on to another speaker. (he reminded the officers that they could speak out as individual citizens as long as the did it out of uniform, on their own time, and using their own equipment).

4. When asked if he supported the citizens rights to issue a recall vote, he said he had no thoughts on the issue because he has not reviewed the law (which I handed him previously).

5. When asked about the process of filing an official complaint asking the commissioners to fire the interim town manager for failure to provide proper oversight to the town, Mr. Rader simply said to write a letter and said that I had already done that, and that no response from the commissioners meant a "no".

6. Mr. Rader was asked if the commissioners had the authority to remove the interim town manager (this after his statement that Mr. Smith was still the assistant town manager) -- he did not answer.

7. When asked about the discrepancy between the advertised purposes of CFK and the actual purposes, Mr. Rader had no comment. He said that CFK was a 501c3, but was quickly reminded that it was not.

There's probably much I'm leaving out at this particular moment. Jamie was there and I'm hoping that she'll be doing an article on this.

The most disturbing reality of all of the Rader Ramblings this evening is the fact that we have such incompetence and arrogance leading our town. Mr. Rader claims to have never seen the deposit slip or to have knowledge of it. He claims to know nothing about other scandals in he community.

I actually think mental illness may be the explanation for Frank Rader's behavior. He can certainly plead insanity as a valid defense when he's brought up on obstruction of justice and witness tampering charges, especially if this CFK/Crone thing keeps getting uglier and uglier. The second review of the evidence room spells serious trouble coming. Does anyone know if Rader brought an attorney with him tonight?

I was present at Commissioner Rader's presentation tonight at the library. I can personally vouch that Mr. Rader made several serious misrepresentations/lies to his audience.

I noticed there was a videotape in the room. Are there any plans to provide that feed to the public? My concern is that without that tape Mr. Rader could backpeddle out of the quandary he placed himself into tonight by outright lying to the public - as an elected official.

After this evening, it is my firm belief that there is no noble alternative to resignation for Commissioner Rader.

Following the meeting last night I followed Mr. Rader's suggesion and submitted a letter to the Town Board. I encourage each of you to do the same. Below is what I submitted:


Dear Elected officials,

Mr. Rader danced around several questions posed to him during his “discourse” he organized to address several concerns. I am more convinced than before that Mr. Rader’s conduct is a breach of his ethical duties and responsibilities to the citizens of this town. My position is based on the following statements or lack thereof.

1. Mr. Rader admits to making speeches at the roll call of the Mooresville Police Department, and disseminating the “anonymous” letter to the officers. Mr. Rader also indicates that he counseled the officers regarding the personnel policies of the Town in that officers were free to respond to the CFK scandal as long as they did so on their own time, on their own equipment, and out of uniform. When asked how that discussion came up, Rader said, “I just said it.”
2. Mr. Rader has a pattern of interfering in the regular meetings and work of the police department, and did not indicate that he had been invited to speak to the officers, but rather took it upon himself to do that. When asked what authority he has to do that, Mr. Rader took out his town badge and waved that around and said, “This does.”
3. Mr. Rader insisted that commissioners have nothing to do with personnel decisions other than the ToM Manager, the ToM Attorney, and the Clerk. If that’s the case, then why is Mr. Rader providing interpretation and counsel regarding town personnel policies?
4. Mr. Rader was questioned about the management skills of the Interim Town Manager in light of the fact that the CFK website was fraudulently advertising CFK as an organization to assist needy children, allowing CFK to be included within the town budget despite not knowing the corporate status of that organization, and for failing to keep the board informed regarding the process of the various investigations. At first, Mr. Rader suggested that the Interim Town Manager is still the Assistant Town Manager but with additional duties assigned to him in the absence of a Town Manager. Mr. Rader implied that since the Interim Town Manager is still the Assistant Manager, there is nothing the commissioners could do to Mr. Smith.
5. Mr. Rader’s obvious interference with the investigation must be investigated. I will be contacting the FBI to ask them to investigate political corruption related to CFK, and Mr. Rader’s activities within that process.

Mr. Rader’s incompetence was highlighted by his inability to answer my question as to the process I would need to follow in order to file an official complaint about the work of the Interim Town Manager. At first, Mr. Rader ignored it, but when I asked it again he said, “Well, write a letter. But I think you’ve already done that.” It became painfully clear that he has no idea what the process is to remove Erskine Smith from employment with the ToM. Mr. Rader suggested I contact the commissioners, so I submit this to you and do expect to hear back from you regarding a response to these requests.

1. Mr. Smith be terminated as an employee of the Town of Mooresville effective immediately, which means that you call an emergency meeting to deal with this. Supporting facts for this request:
a. Mr. Smith failed to provide frequent and timely feedback and updates to the commissioners.
b. Mr. Smith failed to investigate the legal status of CFK before suggesting to front $20000 for the golf tournament.
c. Mr. Smith failed to provide adequate oversight of the Town Website and allowed fraudulent information to be presented regarding CFK.
d. Mr. Smith failed to administer discipline in a consistent manner to all employees, as was evidenced by his handling of the Mr. Crone.
e. Mr. Smith is the Interim Town Manager and not the Assistant Town Manager, as suggested by Mr. Rader. As such, commissioners have a direct employment relationship with Mr. Smith.
2. Mr. Rader be removed from office by a vote of the remaining commissioners. Supporting facts are:
a. Mr. Rader’s frequent interference with the PD
b. Mr. Rader’s counseling of employees regarding town personnel policies.
c. Mr. Rader’s attempted intimidation of witnesses.
d. Mr. Rader’s history of failing to protect the people.
e. Mr. Rader’s abuse of his position by utilizing a town vehicle as well as his presence at staff meetings.

I am more convinced after the Rat Discourse, that this town’s leadership must act quickly in order to regain, if possible, the trust of the public. I demand that the Town Commissioners take a vote to require Rader to resign immediately. I also demand that the commissioners call and immediate meeting to enact the personnel policies in order to terminate Erskine Smith with cause. I also demand that you immediately begin the process of changing the town charter to include the right to issue a recall vote.

Failing to respond and to act on these demands will result in a negative outcome at your next elections. Also failing to remove Erskine before the arrival of the new Town Manager will show us that you have chosen to wash your hands of the situation and are going to use the new Town Manager to do what you, the elected officials, should have done. This, too, will result in your being fired as our elected representatives.

The time to act is now. Do the right thing, and do it now.

On a humorous note Mr. Rader’s Discourse was an amazing show complete with unbelievable dancing and a clown with a bowtie. I did miss popcorn coke and cotton candy. That would have made it complete.
On a serious note it was very disturbing to realize we have a commissioner ether so dishonest and obtuse that he would contradict himself many times to avoid answering simple direct questions about his own actions that are on record and or a commissioner that doesn’t care about the integrity in our town government and has no wish to be informed about the lack of oversight in our government

I had made up my mind to attend last nights premiere event (The Rader Zoo)as a listener. I did ask a few questions, none of which were answered, but as I listened, I found myself fearing I might die from choking on the blood from biting my tongue.

The guest of honor performed as predicted! We had the opportunity to see: Deceit, Arrogance, Ignorance, (this may be the same as Stupidity) Craftiness, Treachery, Hypocricy, Impersonation, and a Sociopathic disregard for the concerns of those who attended.

It was actually fascinating, as he stumbled around, to understand how little he actualy knows about things he was elected to oversee.

Cliff, Michael and Larry were magnificent as they questioned and challenged Mr. Rader. Although they did not receive intelligent
responses, as they attempted to wade through the drivel, I ws reminded of the difficulty a person experiences when trying to drill into concrete.

It is great to see Larry's letter to the Board of Commissioners, and look forward to his forwarding it to the D.A. or S.B.I. - or both. I believe he will have to take this next step, given the make-up of the Board.

Remember, animal behavior is somewhat predictable when faced with the warmth gained from peers in the same nest!

If the heat is reduced, I fear the residents will become complacent at election time, and, once again the myopic ingrate will prevail.

One problem that I see here is that the town officials have no interest in responding to what they view as a few citizens. Ones that they do not deem as being "worthy" of a response. They will continue to ignore requests because they can and there doesn't appear to be anyone that can make them present answers to honest questions.

When you think about it almost two months have come and gone and there are still no answers with regards to the "audits" and "investigations" that are being conducted. That alone should tell us something. Another is the outcome of the golf course investigation. Why wouldn't those results be made public, especially if our tax dollars help to support it. Our tax dollars were also, it appears, being used to help fund CFK if tax dollars were used to support the $20000 by the TOM.

Corruption runs deep and "willful blindness" should be grounds for termination. There are way to many people involved at the base of the corruption and there is no one big enough to get to the bottom of the pile. I know for a fact now that Crone did something on my property and had a civilian with him that signed his support letter which would have been unethical as well as a possible violation of department policy. But it has been said "he got fired so let it go". It is at least a firm reason to see that the corruption runs deeper than the TOM it extends to those that support them. Crone used his position to violate any code of ethics!

I'm very discouraged that we will never probably see these people brought to justice. They don't care about the people just a few people.

I might as well be sitting somewhere watching cement set because that's about the same pace being used by the persons overseeing this mess of CFK, golf course,etc.
What results did Larry get from the freedom of Information Act Requests? Anything?? Is the state ignoring us too??
I say put the feed on Mi-connection and send a copy to local news media. I've never witnessed anything like last night. Did anyone notice the similarities between Crone's comments to the press and Rader's mind maze last night? I think they get schooled about how to dodge bullets.

No, there were no other elected officials at last night's meeting.

The FOIA requests have resulted in a phone call from Mr. Frank, an email from Mr. Gambill, and an e-mail from Ms. Setzer.

Mr. Frank said that he will review the documentation he has and will consider allowing me to read it.

Mr. Gambill says that part of the requested information is covered by personnel laws and cannot be revealed.

Ms. Setzer said that the investgation is still going on and that it was progressing nicely. She had no idea as to a timeframe for completion.

I'll be submitting another request to all parties next week. In the meantime, voice your opinions and concerns directly to the commissioners. Every single one of them should have been present last night, at least to know how much damage control would be needed. Also, they need to hear from you regarding your views on their leadership during this stuff. I know that I offended at least one commissioner by my tone and demands, but I stand behind my promise to make sure that the entire community remembers their lack of leadership at the next election.

Tell them to do the right thing and to do it now.

This is a continuation of the "Count Up Vigil" of the number of days which pass from the day Cops For Kids scandal broke (7/4/08) to the day that Police Chief Crone and Interim Town Manager Erskine Smith are both suspended, terminated or resign.

The Police Chief was suspended (with pay) on Tuesday, 7/8/08. He was terminated on 8/8/08. The community is clearly relieved and deeply grateful that Mr. Crone has vacated his post. However, serious questions continue to mount with regard to Mr. Smith's decision to continue paying Mr. Crone a salary for the intervening month.

Interim Town Manager Erskine Smith, Mr. Crone’s supervisor, remains in his position and continues to operate still. Therefore I shall continue this Vigil until he, too, vacates any post he holds as a public official in Mooresville due to his role in this matter as well as other matters that have been brought to light.

The town board has placed Finance Director Maia Setzer in charge of oversight of the CFK process (including but not limited to any audits and investigations) which indicates that they, too, lack confidence and trust in the Interim Town Manager. Despite this lack of confidence, Mr. Smith remains in his position, a position to which the Finance Director reports.

The information I specifically refer to is:

1) documented misrepresentations made by Mr. Smith with regard to the nonprofit corporation known as Cops For Kids

2) Mr. Smith's direct recommendation to the town board to include the nonprofit corporation known as Cops For Kids into the town's general budget in the amount of $20,000

3) Mr. Smith's failure to perform due diligence in his capacity as Interim Town Manager by properly researching Cops For Kids prior to submitting his recommendation to the town board

4) Mr. Smith's involvement in a questionable commission in the amount of $237,151.50 as outlined in the Gatton Report blog entry dated 4/18/08 and titled “Friends don’t let friends gouge Mooresville taxpayers”, the contents of which have never been publicly disputed by Mr. Smith

5) Mr. Smith’s failure or refusal to change Mr. Crone’s status to “unpaid” suspension despite the surfacing of various contradictory statements made by Mr. Crone in the media since his suspension

6) Mr. Smith’s failure or refusal to fire Mr. Crone despite his assumed knowledge of the damning evidence presented in a Gatton Report articles dated July 22, 2008

7) Mr. Smith’s failure or refusal to insure that a complete financial audit is conducted and released of Cops For Kids records, despite the mayor’s assurance that this process had begun on July 8, 2008

8) Mr. Smith’s use of double standards when enforcing employment policies, as evidenced by his statements in the August 2008 “Town Voice”

9) The fact that Mr. Smith staunchly resisted firing Mr. Crone until after there was citizen unrest which resulted in a citizens protest on the Mooresville Town Hall on 8/4/08. The protest in turn brought about significant negative publicity for the town. Mr. Smith’s inexplicable delay in firing Mr. Crone therefore ultimately resulted in tarnishing the town’s reputation

It doesn't matter that Frank sends his propaganda emails from his personal email account. The public records law deems public all those records received,sent, or generated by a public official in his official capacity. Because Frank compiled the email list in his official capacity as a commissioner, the list is a public record. The statute is plain on its face.

One attendee from last night wrote that Frank Rader told his audience that the town board cannot fire Erskine Smith, the Interim Town Manager. You may add that to the list of blatant lies told by Commissioner Frank to the citizens of this community. The town board can absolutely fire Erskine Smith. Their decision to keep Smith on despite everything they are aware of is tantamount to a decision to saddle their incoming Town Manager with the remaining scourge of a past era. In so doing, they have irreparably shirked their public duty. This is a decision that will taint each and every one of their soon-to-be short political careers.

I understand none of the other RATS showed up last night - no Abraham, no Thunberg, no Smith. Left ole Bowtie out there all by himself. No wonder Frank's hanging on to Erskine for dear life. None of his colleagues on the board wanna touch him with a ten foot pole. Maybe Erskine'll be so "grateful" Rader is trying to save him from being fired that he'll remember and return the "favor" down the road? Only problem is that we'll all be there watching like hawks. Hang it up fellas. Talking to you Erskine and Rader. Admit it. It's time to throw in the towel and leave with at least a little shred of dignity.

Here’s another Rader flat out lie for you. I was there last night and got another interesting tidbit. Rader has claimed that he puts everybody’s correspondence to him in his At-Large, but it turns out that a couple of well-known local activists’s letter never made it into his At-Large. How very convenient specially since they were calling him and Smith on the carpet. This guy is full of baloney. I don’t even think he knows what’s truth and what’s a lie anymore. Pretty scary to have somebody like this up there making million dollar decisions for us.

Since it looks like the town wants to hang onto Erskine Smith’s corrupt butt, I guess we’ll just have to do what we had to do with Crone. Investigate him ourselves and get rid of him. What's one more stink on all the local channels? It doesn’t look like he wants to take the easy road out of town. Let’s show him the hard one.

If you are referring to Frank the DA, No, he bought himself some time when Jaime came out on Friday with an update that said 2 weeks. So I am waiting, if you are referring to me taking my fight out of Mooresville and into the county and state, Yes, If you are referring to me going after police fundraisers, yes, If you are referring to me taking on the FOP, Yes, IUPA, Yes, if you are referring to me and crone, Yes, if you are referring to Crone Smith Rader and Thunberg, Yes, with the exception of Thunburg, but I will get him in it too, his silence is deafening. If you are referring to Lodge 10, No, I was asked to back off and am choosing to do so, If you are referring to Cooper, No, no need to go after him, he is a good man. And I would like to see him live up to his statements.

Here’s the deal folks. Can’t tell you who I am but I’ll tell you this. If you live in Mooresville I know you or I know of you. If Frank Rader told you that he didn’t see the famous SLIP showing the police chief had started dipping into the evidence room, then he is telling you a bold face LIE. Now Frank likes to tell a lie but this particular lie could be The Lie that cooks his goose. Somebody else had called Erskine a Politically Dead Man Walking. I'm gonna borrow that phrase. Heck, I'll shorten it for PDMW. And you can now add Rader to it.

Rader acts like he's had a hit of acid or is suffering from a flashback from an earlier party. It's about as bizarre as him sauntering into agenda meetings with his Earl Grey tea and bowtie.I think he aspires to be a professor at his alma mater. Maybe in that mind of his we're just students in a lecture hall to whom he's imparting"wisdom"....
