Accused deputy still employed by sheriff

Ben Jenkins, the sheriff's deputy that a Kannapolis woman is suing for sexual harassment, is still employed today as a patrol deputy with the Iredell County Sheriff's Office.

But Capt. Harold Miller, who has been with the sheriff's office since 1994, retired unexpectedly this week, according to Capt. Marty Byers, personnel director for the sheriff's office. The timing of Miller's retirement does not appear to be related to the lawsuit filed this week by Suzanne Wick against Jenkins and Sheriff Phil Redmond.

Wick says that Jenkins – a detective at the time with the ICSO's Domestic Violence Unit - sexually harassed and stalked her in early 2009 while she was working through the sheriff's office to charge her then-husband with domestic abuse.

Wick's ex-husband pleaded guilty in January to domestic-violence charges.

Byers said today the sheriff's office still employs Jenkins as a patrol deputy.

Jenkins, 45, who began working for the sheriff's office in August 2002, was demoted from his position as detective in 2009 after Wick apparently complained of his sexual advances, which she says began in February or March of that year – just about a month after she first approached the sheriff's office for help in filing charges against her abusive husband.

Public information in Jenkins' personnel file seems to corroborate the timeline of events in Wick's lawsuit:

According to the suit, on or about April 19, 2009 – just two days before Iredell County's personnel file shows Jenkins was suspended and three days before he was placed on administrative leave – two men, presumably from the sheriff's office, interviewed Wick about Jenkins' conduct in her case.

A few days later,” the suit reads, “the two individuals reported back that they corroborated misconduct by Jenkins.” It says the two men asked Wick what she wanted them to do, and “she said that Jenkins should lose his job because she feared that Jenkins would do this to another woman.

Shockingly,” the suit reads, “the Sheriff's Office refused to terminate Jenkins. Shortly after that, the two men reported back that Jenkins was demoted to jailor.”

The county's personnel information seems to corroborate that. It states that on May 4, 2009 Jenkins' position was reclassified from detective to jailer.

Last year, the suit states, it was discovered that the sheriff's office attempted to restore Jenkins to a detective position but that “the Gaston County Domestic Violence Protective Council and/or elements within the District Attorney's Office may have opposed the move and Sheriff Redmond subsequently moved Jenkins to a patrol position.”

Jenkins' public personnel information shows that he was, in fact, promoted back to detective on Nov. 7, 2011 (after he had moved from jailer to deputy sheriff in November 2010). But just two weeks after he was promoted, on Nov. 23, 2011, he was demoted back to deputy sheriff.

He is currently a road patrolman, making $38,972.04 a year.

Redmond is named in the suit for neglecting to act on information about Jenkins' misconduct.

As for Harold Miller's retirement: Human Resources Director Sandra Gregory said this afternoon that her department has not yet received paperwork verifying Miller's retirement. But ICSO Capt. Marty Byers, in an e-mail to the Report this afternoon, confirmed that Miller is, in fact, “a retired employee from the Sheriff's Office.”

Miller, 63, started working for the sheriff's office in December 1994. His salary, according to information on file with the county, was $62,025.19.

The crimes and issues that infect the Iredell County S.O. are not unique and currently touch several departments that have been in the news across the state.

Phil Redmond's way of doing things is not new to him or the deputies that he employs. Most are hard working and want to do a good job but let's face facts; most employees of the SO are there b/c they were friends of his, made political contributions both monetary and in other ways or in return for "favors".

He is seldom in the office but receives a paycheck from the county for "services rendered" and has very little oversight of his kingdom by the county. He is able to virtually do what he wants to because of state law that makes him responsible only to voters.

He can hire and fire at will with employees having NO protection under county policy because of a state law that says employees "serve at the pleasure of the sheriff" because he is an elected official like the register of deeds. There is no recourse to this unless he violates a federal discrimination law which he avoids by simply not giving the former employee a reason. After each election some employees are not reappointed. Why is it that every other county employee has some employment protection as long as they do their jobs, follow policy and comes to work but this is not good enough for COUNTY EMPLOYEES who work for the sheriff and register of deeds. He will say that he has to employ people that he can trust and who support him but other county employees do their jobs even if they don't support the policies of their bosses.

His budget is not overseen by the county, which trust me, frustrates county officials because they are required to provide funding to his department but they cannot stipulate how he dispenses that money. Because his "office" is a constitutional one, he can continue to do what he wants unless removed under court order after a LENGTHY process that is rarely undertaken (former Davidson County Sheriff Gerald Hege is an example). You can bet there is dirty laundry in that basket that needs to be washed.

The office of sheriff is an outdated position that has been around for thousands of years and is as corrupt now as it has been since merry ole England. The position should be changed to an appointed one where the sheriff can be fired by a majority of the county commissioners or county manager like a police chief can be fired by a city manager, mayor or city council depending on the form of government in the municipality.

This blog has a lot of things that has happened while Redmond has been in office but it only scratches the surface. It goes back to when he wrecked his county issued car years ago after having been drinking but this was covered up and the county garage took care of getting the car repaired. Who do you think paid for that - it wasn't an insurance company.

If the president of the United States can only hold office for two terms (8 years) than that should be good enough for all elected officials especially an office as politically bullying as the sheriff's office.

The county commissioners had better take an official stand on this issue. Remember three of them are up for re-election and they have plenty of competition. If they do not have the courage to state publicly their opinions they should not get a single vote. All women in this county should pay close attention to what they say. If they do not publicly side with the women in Iredell county then they should not receive a single female vote. It time to see which of the commissioners or prospective commissioners have the guts to do whats right. Any who do not publicly state their views are to be considered cowards and should, and I think will, suffer the consequences of their cowardice at the polls in May. Also if Miller was forced out why isn't Dowdle right behind him? Plenty of war stories on his behavior. Ladies contact Mrs. Wick's Attorney a you to can become independently wealthy. I'm sure a class action lawsuit is in order. Another point to be made is the fact that it appears to me that there are civil rights violations that need to be addressed by the FBI. The County is in a precarius position with Redmond and this case in general from a legal stand point.

Although the SO is basically autonomous in the scheme of things, the County is on the hook because it provides the funding. The County can ask to be release from the suit under the doctrine of soveign immunity which basically says you cannot sue the government unless it allows you to b/c in essence you are suing yourself because you pay taxes in the county and to the County.

The County can claim that there was "no negligence" on its part because every county employee knows through policy that sexual harassment is not allowed. Therefore, Redmond and Jenkins should be sued individually.

The other side of the coin which Wick's attorney will probably jump on is a doctrine called "negligent retention" which basically says that if an employer has had similar previous complaints or is aware of specific behavior and they did not fire the individual than they are assuming liability for any future similar acts by retaining the employee. This is where the County becomes liable in the eyes of the court and the County is on the hook.

Then there is the "failure to act" doctrine which basically says that even though you knew an action should be taken, you failed to take any action to correct a violation of law through inaction, inappropriate action or negligence.

Then we have the one that the Justice Department uses in almost every civil rights or corruption case involving law enforcement. that is Redmond, Jenkins, Miller, Eades, Carpenter, McDaniels, Dowdle and the rest of them did their dirty work "under color of law". In English this means that they did these acts of corruption as law enforcement officers that knew the laws and hid behind a badge.

What would really be great for all the residents of IC would be if the FBI got involved and not only looked at civil rights violation but also investigate Redmond and the entire department under the RICO statutes. These are used when there is a pattern of numerous violations, involvement of money and multiple people. Most judges sentence offenders under RICO to life in prison with no parole. Redmond is a mobster and his empire is a "continuing enterprise" the way the stastute reads.

Ms. Wicks is absolute right to sue and I am one that often looks at lawsuits as people just wanting a free ride or will sue for anything but in her case she was abused continually, threatened, harassed and intimidated by thugs and deserves compensation. My hope is that her attorney will get her a fair deal and that part of that deal comes right out of the pockets of Redmond and Jenkins personally and that through her perseverence these two pieces of sludge in a sewage plant will never carry a badge again.

Everyone who has a computer or a phone should forget about the Commissioners and contact the District Attorney's Office, the SBI, US Dept. of Justice and the FBI personally to pressure them to investigate the ICSO as expeditiously as possible but remembeer wheels turn slowly and it could take months or years to do a corruption investigation into Phil Redmond and his "boys".

Democratic Governor-Republican Sheriff- she is not seeking re-election anyway so she would make a bold statement ordering an investigation. Better yet, a petition to ask the United States Department of Justice to investigate the drunk with the
70's haircut and his "boys". When it is all said and done, they could shave each other's balls in cell they share at the penitentary in Atlanta or better yet SuperMax with all the other terrorists. They would find plenty of opportunities for anal sex and sitting on each other's face among other things. I think I would be inclined to put up the first $20 in their commissary accounts if they went to the big house. Only problem is that few would sign it out of fear of retaliation, being set up or worse.

March 26, 2012 9:07 AM. Without knowing all the facts, the answer about a deputy going to North Iredell in uniform questioning a "kid" about having sex with his daughter is "possibly"

First, it would be imprudent for an officer to interview anyone in uniform in something that involved his daughter because it definitely gives the appearance of intimidation and would bring up serious issues in a trial if things would eventually go that route for whatever reason. Second it is obvious that the deputy probably went to the school in uniform purposely to intimidate and possibly embarass the kid being called out of class in front of his classmates and school administrators. I would really be surprised why a principal would allow a kid to be interviewed at school without knowing the circumstances and certainly if it were official an SRO would know about it or be present.

If one of them were younger than the age of consent in NC (16) than yes there could be a violation of law on the kid's part. However, depending on the age of the kid interviewed, if he were under 16 his parents must be notified period. Basically what I am getting to is that if BOTH kids are 16 or over than daddy deputy can do nothing about the kids having sex in NC because NC law sets the age of consent at 16. Minors under 16 CANNOT give consent to sexual activity under any circumstances which causes charges like statutory rape, crime against nature statutes,indecent liberties with a minor laws etc to be utilized.

Now, having said all that, it would be questionable as to a federal violation of acting "under color of law" in a civil rights case. Intimidation was present using his uniform, badge and position of authority to intimidate. However, he would always say that he was just trying to scare to kid into staying away from his daughter and not for financial or personal gain which would under cut the "under color of law" argument.

In my opinion, the deputy was stupid. Very questionable as to whether he did anything "criminal" or violated the kid's civil rights but he surely would have warranted some kind of punishment for an "unauthorized use of his uniform and position" which would be a departmental policy issue. With that in mind, Phil Redmond undoubtly would have never done anything to the deputy and probably would tell him he would have done the same thing.

I would have a talk with the principal and SRO and advised them that unless there is a criminal matter involved you child is not to be removed from class to be interviewed again or face legal action. This could include harassment or if things get really bad such as the deputy following, calling, stalking or futher intimidating the kid there is what is called a 50C order. A 50C is similar to a domestic violence order known as a 50B but it is an order by a judge to the offender to stop communicating, harassing, threatening etc the person. Violating this order can lead to going to the Phil Redmond flea motel. A 50B involves domestic violence between 2 associated parties whereas a 50C is not domestic in nature but is to prevent harassment between 2 parties.

Yes age of consent in NC is 16 however there are some other exceptions such as less than 3 years age difference. So in a hypothetical case: a 14 year old girl and a 16 year old boy still would not be breaking the law.
2nd point: A person can not show up on school grounds and remove any student from class without legal justification. To do so without authorization and/or parental consent is "
2nd degree kidnapping" as this deputy used their authority and of course were armed with at least a handgun to remove a child (albeit temporairly) from a place they were supposed to be.
So a person with a law degree could conceivably argue the deputy should be charged and could be convicted of breaking law of kidnapping and possibly communicating threats.
That unfortunately sounds very familiar to Ron Hillard's actions as Assistant Chief of Mooresville PD at Brawley Middle School involving his daughter. Hey wait Mooresville fired him though. Guess that is what a good supervisor does. What does Redmond do? Nothing in the North Iredell case and he even hires Hillard and puts Hillard back into the public to threaten and harass another student ... Imagine that

1:52 AM thanks for the update. I am thinking Hillard threatened. Not sure if this incident went past interrogation about oral sex, but the sense of threat would be there with the Deputy being an adult and with his position of authority. I guess when you are head of the group that works the school you can get by with that? Also is there a statute of limitation on this?

I spoke in general terms of the statute that states the age of consent.

I also assumed that based on the question that was put out that there was no weapon used, no threat of force or coercion. I addressed the use of the badge and position of authority to gain access to the "student" and "interrogating/interviewing" him under color of law if there were not a legal reason to speak to the student. It is entirely possible that the deputy may have been trying to find out if a criminal violation had been committed because we do not know what the deputy's daughter had told her father. Albeit that the deputy should not have done a preliminary "investigation" himself because it involved his daughter, he may have been in an information stage which could have been argued that he had a "legal" reason to interview the boy. I addressed this by saying the boy's parents should have been notified.

A second degree kidnapping would be an absolute stretch and would not get past a grand jury unless there are other details that were not presented in the original question. As you know "intent" has to be shown in one way or another and an attorney who graduated last in his class from a law school in the carribean could argue the "intent" to comment a second degree kidnapping offense was not present.

So you see, I don't need to go back to BLET and pay attention, you need to wake up to reality and stop trying to find something that is probably not there although I throughly agree the deputy was wrong for going to NIHS and speaking to the kid.

The person who asked the question followed up by saying that both were of age of consent. It is difficult to address every single angle of a question such as that without sitting down with a person to get all the answers to determine what elements of an offense may or may not have been fulfilled. That is why I suggested he contact an attorney if things continued.

So no need to be sarcastic with your go back to BLET comment. I have a sheep skin credential on the wall to address his question as well as I teach criminal law to BLET recruits if you really want to know. So much for an abbreviated response.

I have tried to keep quiet, but can no longer sit by and watch this.

The media has made a circus out of nothing and it is due to the work of a handful of people with axes to grind. Sheriff Redmond and ALL of his officers have and continue to provide professional services to Iredell County.

I have personally known Sheriff Redmond my entire life and he is an upstanding citizen and wonderful person who is appreciative of the time he has had the honor of being Sheriff.

He holds his men to the same high standard that he adheres to himself. I have heard the same rumors you have heard over the years; Drug sales. Firearms being sold from the evidence room. Gambling kickbacks. Womanizing. Drunk driving. Extortion. Sealed Federal indictments. Moonshine running. Sexual harassment. Threats and so much more. I have heard it all and seen it written here but it is all lies made up by a handful of people that are jealous of the good job he is doing and the longevity of his position as Sheriff.

I encourage Phil to step up and face all of these allegations and finally lay them to rest. He will have my support and the support of the vast majority of the citizens of Iredell County who respect him for all he has done and accomplished since being elected as out Sheriff.

You have the wrong Hillard. It is Kendall Hillard that was at Mooresville PD and Redmond hired him. Ron Hillard retired from NCSHP. They are brothers. Their dad retired years ago from Statesville PD.

Am I the only one that found it strangely inappropriate, given the charges against deputy dirty dawg, that he is now a jailer?

Or doesn't Phillip get irony?
