Commissioner Chris Carney – who told town officials that Mayor Chris Montgomery applied for a job with local developers who had business before the town – was himself listed as a member of a company with one of those developers.
Carney and Langtree Group developer Brad Howard are listed as managing members of “Slush Fund, LLC,” a company that was created in October 2008 and dissolved effective Dec. 31, 2009, according to documents filed with the N.C. Secretary of State.
But Carney said the company was actually a charitable concept turned joke. “I had nothing to do with the corporation of that business except that I was in the initial conversation about helping local charities process credit cards for donations,” he said, pointing out that his signature is not on any of the documents filed with the Secretary of State.
Carney said the initial concept of the business – to help smaller Mooresville charities accept credit-card payments and keep the processing fees – was a joint idea of his and Howard's, both of whom have sat on non-profit boards like the United Way, YMCA and Dove House Children's Advocacy Center.
“Brad and I both sat on a charitable fundraising committee (actually several) and there was a need for credit card processing,” Carney wrote this week in an e-mail to the town board, town attorney and a Mooresville resident who confronted him about Slush Fund LLC after it was brought to light in the comment section of the Report.
“To the best of my memory, a representative from Heartland (Payment Systems) brought this to Brad and we looked into it as a possibility,” Carney wrote. “They needed a corporate ID for processing. I was really only involved in the preliminary discussions and had nothing to do with the filing.”
The Slush Fund name “was my idea,” said Carney's childhood friend, Jon Wright, who is also listed as a managing member of the company. He said the company was named Slush Fund “because it was not designed to make money – it was just designed to pass savings on.
“Unfortunately, Chris's name got added, and I don't know how,” he said.
Wright, who lives in Hickory, said he has always viewed Carney as a friend and not a political official. “I guess I need to change that,” he said.
Howard agreed that the company was named Slush Fund “in jest.”
Carney said that upon learning of the prank name, “I asked (Howard) not to have my name associated with it as I thought it to appear inappropriate. I did not like my name being associated with something called slush fund.”
He said that he and Howard “found a better way to run the credit cards and moved on.”
Last month, Carney informed fellow commissioners that Mooresville's mayor had sought employment with Langtree the day before the developers were to appear before the town board for an adjustment to their tax district. Carney called Montgomery's pursuit of employment with Langtree “an unfortunate and certainly improper situation” that “needs to be dealt with.”
The developers rejected Montgomery's application because they had business before the town, Carney told commissioners. “They felt it inappropriate to even be perceived as a conflict,” he said. “I think we should thank them for their integrity!”
In a letter to Langtree's Rick and Brad Howard, Carney wrote: “Any elected (official) seeking a job with organizations that have business before the town is inappropriate, but certainly your situation, tax districts and joint infrastructure projects, makes it that much worse. Please accept my apology and my sincere appreciation for your making me aware of this issue.”
So what makes Carney's involvement with Slush Fund LLC and Howard any different?
“This was never a real company, and I never received nor attempted to receive any income or opportunity from this entity,” Carney said. “I actually think I paid a nominal amount to dissolve it.”
Carney submitted a copy of his personal taxes to Town Attorney Steve Gambill this week in case commissioners or the public has questions about whether he profited from the business. Gambill confirmed on Wednesday that Carney made no personal money from his association with Slush Fund, LLC.
Still, Carney said he fully understands that having what appears to be a business with a developer would seem improper. “And for that, I'm sorry,” he said, adding, "I feel terrible that this is a distraction for the citizens of Mooresville.”
Carney said he has never hidden the fact that Howard is among his friends. “I have made that as a public statement on several occasions,” he said. “I have friends in many circles that do many things, and it's never gotten any of them influence on our town board.”
Interestingly, on the same day the articles of corporation for Slush Fund, LLC were filed with the Secretary of State's office, on Oct. 17, 2008, Carney was quoted in the Report saying: “I have business with developers, and I’ve had wine with developers – I’ll be the first to tell you.” However, he said, “A glass of wine doesn't buy a vote, and if (it does), that's a bad thing.”
Carney, who owns a title insurance business, said he has also played golf with developers but that he pays his own way.
He said he once recused himself from voting on an issue because it involved a developer who has gone with him on mission trips.
Carney said being friendly with developers is one thing - allowing friendships to cloud judgment is another.
He said this week that Howard and Wright have apologized to him for using his name on a business without his permission. “They didn't do it maliciously,” said Carney, adding: “If I have to give up friendships for this job, it isn't worth it.”

You drink with Rick and Mini Me Howard, you eat with them, you play golf with them but you expect me to believe that just because you don’t report any income from them on your tax return, you don’t get gifts and favors under the table? OK, the Slush Fund may have been set-up for good reasons but Carney's close relationship with the Howard's has to be questioned. The Town deserves a Board which is composed of unbiased Commissioners; nothing less. Carney has been a strong proponent of 'vertical' development (His words, not mine).

This sounds a bit biased towards commercial development to this writer.

One thing I for one can prove is that the guy they erected as our town manager, Erskine Smith, has been taking favors for years, and they ALL KNOW IT, EVERY LAST ONE OF THEM. But they still put him in that $120,000 a year job. That's all I needed to know they've all got something to hide. Why? Because NONE OF THEM came out publicly to denounce his being put into that position. And who pushed the hardest for it? Mitch Abraham, so now guess who owes him? You got it, Erskine. And where are the others? Mum.
Makes you wonder what Abraham has to gain by Smith being town manager.

Langtree group is known for becoming "friendly" with anyone with the slightest bit of power. Carney is best of buddies with the Langtree crowd, as are other elected officials. Montgomary's attempt at affiliation is nothing new and is not admirable. However, it is a bit odd, that before Montgomary's election, Langtree would not have entertained associating with Montgomary. Rather, Brad Howard campaigned most of election day for Bill Thunberg because "Thunberg had so many connections with Raleigh." May it be that Langtree wants another Mayor to serve them and their needs once again?

No, we don't think you should give up friendships. Keep the friendships but give up the Commissioner job. NOW! You have been compromised by your close association with the Langtree Group, plain and simple. We cannot count on you to have the Town's interest first. You have, in your words, told us your Friendships come before anything else.
Additionally, you have yet to answer these questions;
1. Why you accepted the information regarding the Mayor request for Langtree employment. Why didn't you refer them to the Town Attorney's office as is standard protocol?
2. Why did the Howards feel more comfortable with divulging this info to you? What form of Friendship is that?

Every time Carney opens his mouth, I am reminded of something Abraham Lincoln said: "Better to remain silent and be thought a fool than to speak out and remove all doubt."
As concerned as I am about this emerging situation of elected officials getting buddy buddy with developers, I am even more concerned about reading that our current Town Manager has accepted gifts, favors, or other things. If this is the case, why is he still employed with the town? We as voters and taxpayers can vote out elected officials who engage in misconduct, but we have to depend on elected officials to get rid of town employees who engage in such misconduct. Who has dropped the ball here?

Article V Section 7 of the town’s personnel policy states: “An employee of the Town shall not accept any gift, favor, or thing of value that may tend to influence such employee in the discharge of the employee’s duties, or cause the employee to give someone a favor, service, or thing of value.”
Why does Erskine Smith still have a job with this town?
What did Husemann, Justice, and McLean have in common? They were all Mooresville town managers who were assisted by Erskine Smith. Assisted right out the door. As far as why that loser's still got a job let alone a job running the whole town, use your imagination.
Get used to footing the bill for Erskine for years to come. He’s got dirt on all these turkeys, and he’s here to stay. They can’t afford for him to start spilling his guts.
So Mr. Carney throws the mayor under the bus for a potential conflict of interest and yet he has his own questionable relationships with the Langtree people.
I don't think our elected officials have to live in a vacuum and have no friends but he obviously should have taken himself out of any Langtree vote. His friend's project would've still passed, and his integrity would still be in tact.
It does make you wonder whether Carney, Radar, and Thunberg shared any "wine" with any of the officials of BVU before the MI Connection vote.

Is it proper for Commissioner Carney to be voting on anything related to the Mooresville South Iredell Economic Development budget requests since his brother is employed with that organization? And lo and behold, there's a Howard serving on the Board of Directors of the MSIED -- overseeing the work of Robert Carney. That's just a little too grey for me, and a few too many intertwined relationships.
The Downtown Commission does not receive funds from the board, so there is no direct relationship between the Board and the Downtown Commission -- so there appears to be no questionable ethical practices related to him serving on the Board and his wife working for the Downtown Commission. If I've missed a financial link between the DC and the town budget, please feel free to correct me.
I have thought the Howards were shady since mini me ran for Iredell County commissioner in 2006. Wasn't that the same year the fabulous yet to be built langtree project was announced. Poor Brad ran as a republican thinking his money and the fact that this county is solid GOP would surely result in a win.Brad's campaign literature claimed he was a lifelong Iredell resident but everyone knew that wasn't true. He was a full time Mecklenburg county resident while he ran that bar/club into the ground in Cornelius. What was it called Brad? Club Vertigo or something like that The people of this county were smart enough to see through that as we was beaten in the primary. He tried it again in 2008 and was beaten again. Was Brad really that interested in serving the county or was he more interested in serving he and his dad? I think the later. Now I don't have anything against developers as my family has some interest in this line of work as well. However we have never sought to buy influence or be buddies with lawmakers. Brads statement today and those he's made in the past all refer to how they are doing something to help the community and create jobs. What a joke! businesses exist to make money, not provide for jobs or whatever else he is saying. The howards are failed businessmen that just can't admit it yet. Town Attorney Steve Gambill said Carney provided him his tax filings that show he lost money. "He did not gain anything," Gambill told the commissioners.
But what did the Langtree Millionaire developers gain from Carney? This STICKS to high heaven! During the Langtree at the Lake Town meetings, Mr. Carney could not have been more supportive of his friends at Langtree.
So the questions remain Chris Carney! How about answering them loud and clear? We do not need a Commissioner in a Millionaire's back pocket!

This mega development, voted on in 2008, should re-voted with current Board (Carney and Montgomery excluded!) and with full knowledge of SAID relief and tax concessions which have been granted Langtree. Along with a 'current' Traffic Impact Analysis and and Environmental Impact study, both of which were hurried through the Town Hall because our previous Mayor didn't want to overburden the Millionaire Developers with delays.
These studies are over 4 years old and MUST be re-looked before vertical development commences and without any Board bias. The old TIA claimed that Williamson Road would see a minimum of 2400 new car trips a day to accommodate the Langtree project with virtually zero infrastructure improvement demands placed on Langtree.
Again, the previous Board and Mayor didn't want to encumber the Millionaire developers with infrastructure costs.

Mayor Montgomery was wrong in doing what he did and Commissioner Carney is equally wrong for his association with the Langtree people.
Not getting off the subject, but cameras were installed in Bellingham Park and North Main Street Park for live streaming of games? Will cameras also be installed at Stevenson Street Park, Nesbit Park, Willow Valley, Magla Park and Bell Street? I'm sure parents and grandparents would appreciate your investment in internet access to achieve academic sucess. Everyone deserves to be on a level playing field.

We are justified to have serious concerns about the impartiality of the commissioners regarding Langtree and Brad Howard. Information from the Secretary of State's office seems to indicate a lot more co-mingling than Carney is admitting.

It's hard to believe that Carney is innocent of having any improper ties with Langtree. Are we to believe that his real estate partner formed the company and his friends-at the suite next door to his business-added his name to the company as a member and he knew nothing about it for an entire year until Brad Howard dissolved the company? Really? I'd be more interested in seeing the corporate documents and corporate tax returns of the Slush Fund to see exactly who profited during that year. To be continued....

It's hard to believe that L3 Development Partners and L3 Realty (that Carney's partner formed and friends Brad and Jon are involved with), and possibly some of the other companies, are not related and Carney doesn't know anything about it. By the way, the office of L3 Realty, which has an assumed name of Langtree Real Estate Group filed in Iredell County, is now located in the same office of the recently departed Forest Grove group, which employed Mitch Abraham, but still lists it's address at the cozy group on Gateway Blvd.
Attorneys form corporations all of the time. But Mr. Balsamo is only listed as registered agent of a total of 14 corporations, in the last 4 1/2 years, 8 of which are listed above. The dissolution of some of the companies seems odd. The fact that the companies seem to be local and real estate related, that Carney's partner formed the companies, that Carney is a partner in the title insurance company and that Howard, Langtree, Balsamo and Carney are in the same office group seems to be a conflict of interest. Title insurance is a lucrative business. All of the transactions at Langtree would have to obtain title insurance. In the interest of full disclosure, Carney needs to disclose if his company has issued any title insurance for the Langtree/Howard deals so far.
There are too many close relationships that make it impossible for us to believe that Carney can be impartial where Langtree and Howard are concerned. We need some truthful answers before Carney is allowed to vote on any more of these projects.
Thanks for the personal history lesson on the above parties. It does not seem strange to me that these guys got together to form partnerships. Good friends do it all the time but you probably don't know that because it sounds likes you spend most of your time investigating other folks. I think but am not sure that Mr. Carney Mr. wright have been friends since high school and do know they were roomates in college, shame on them for wanting to continue there friendship and maybe fulfilling a goal of being in some type of business together. Iam also pretty sure they search high and low to put there offices next to the Howards so they could save gas money in there big luxury cars to have secret meeting to screw the folks in Mooresville, get a life Buddy
